Don't compare Chinese 'manufacturing' to Alec Peters... It's an insult to Chinese 'manufacturing'... Every watch I've ordered from China, has always arrived in the promised timeframe, been as described, done the job required of it...
Did you know that the reason why Chinese factories are producing those goods, is because the original companies out-sourced production there to save production costs and increase their profits, and the factories which provide the officially required parts, simply produce surplus which then goes into the 'other things'? If it wasn't for the greed of the original company, then the counterfeit market would still be at the level of crude and inaccurate copies which almost kinda ish look a bit like the real thing but still identifiable as not-original, not at the 1:1 level which existed say, six years ago (before the companies started getting scared by the counterfeiting and started coming down heavy on the outlets)
If those original companies produced goods at a reasonable price, rather than an artificially inflated one, then while there would still be a demand for their goods, everyone would be able to afford them, and there would be no call for counterfeits... Supply and demand at its most basic...
So no, Alec Peters should not be compared to them, because he just dangled a product, then scammed all the backers by using the money for his own ends... The sellers who tried similar tricks in the watch-collecting community were always quickly identified and ostracised, the ones who did good business, were successful...

That means, we could win this case and have Axanar back in production in March, 2017, Yes, we will finish Axanar!
And we should be hearing in a few weeks on Judge Klausner’s decision on our motion to dismiss. And despite a certain conspiracy nut’s claims, we expect to win at least part of that motion. (My money is on the judge dismissing at least the claim against the film Axanar, since we haven’t even begun production and so you can’t even judge a fair use defense).
Interestingly, the Judge only had two scheduling meetings on his docket and had cancelled the TEN or so hearings he had on his schedule. As Erin pointed out, this is SOP for Judge Klausner, and shoots down another crazy conspiracy theory by the same conspiracy nut.
So stay tuned for more info! With Mike Bawden flying to L.A. for planning meetings Thursday, we should have some interesting announcements in the next couple weeks.

In the meantime, we continue our efforts to settle this matter with CBS and Paramount so we can move forward with telling the story of AXANAR in a way that satisfies both the studios and the over ten thousand fans who financially supported our project.
The trial date has been set for January 31st, 2017.

G&T Show continues to kill it, in the breakdown of this case... and they have continually said that the language issue could get upheld completely, and Klingon could become public domain... but, it still doesn't clear the other very large hurdles, LOL. They compared it to facing a 700-ft. tsunami (with the Klingon language intact), or a 675-ft. tsunami (without the language).

I already knew about the legal issues, but I wanted someone that knew more than me that has been keeping track of it to share. You might find it difficult to believe, but my comment was genuine. Also before 'people' start accusing anyone of not reading. I did happen to read the linked article in the first post before commenting, but I was hoping someone could update me quickly without reading a total of 32 pages of posts.
I think it is wrong for CBS to wait until the last minute to decide to sue a company on the basis of fan film looking too professional. How long before it becomes widely acceptable for companies to follow suit and sue people on the grounds of "copyrighted elements and distinctive costumes" Sounds like they are grasping at straws and if they succeed, I expect all crowdfunding fan films, art, and literature to be sued and forbidden in the foreseeable future.
That's just my perspective on the matter, I am sure others have theirs.

Thanks marcusdkane for your input, it's really unfortunate it's not going to be produced. It had great potential and seems like a waste that it won't see the light of day. And it's kind of disheartening to see petty and legal squabbles destroy creativity over money. There are far worse things happening in the world that some people seem to forget.

I think using the Croudfunding to essentially make money might be a problem. If it was an original indie story, as in not associated with any established franchises whatsoever, might not have been a problem. But the fact that this was done under a Star Trek product that was NOT licensed by CBS... that's where the problem came in. As Star Trek belongs to CBS, any project that makes money would have to be working with CBS in some way. Axanar was not and apparently crossed a line.
As for the nonsense... from what I know CBS slapped them with a lawsuit and Axanar countered by saying it wasn't specific enough. So... CBS got VERY specific.

This is how he should answer it, IMO. G&T Show continues to kill it, in the breakdown of this case... and they have continually said that the language issue could get upheld completely, and Klingon could become public domain... but, it still doesn't clear the other very large hurdles, LOL. They compared it to facing a 700-ft. tsunami (with the Klingon language intact), or a 675-ft. tsunami (without the language).
It's a distraction, and not worth *this* court's time. (I think he leaves the door open with the "without prejudice" part, but it's gotta be in a separate case.)

Thanks marcusdkane for your input, it's really unfortunate it's not going to be produced. It had great potential and seems like a waste that it won't see the light of day. I think it is wrong for CBS to wait until the last minute to decide to sue a company on the basis of fan film looking too professional. How long before it becomes widely acceptable for companies to follow suit and sue people on the grounds of "copyrighted elements and distinctive costumes" Sounds like they are grasping at straws and if they succeed, I expect all crowdfunding fan films, art, and literature to be sued and forbidden in the foreseeable future.
That's just my perspective on the matter, I am sure others have theirs.

Sorry we snapped at you, it's just your post honestly did come off as clueless considering what we've spent the better part of thirty pages talking about. This isn't a "petty legal squabble": Alec Peters' own financial documents (linked earlier in the thread) state he went way past making a fan film and was basically making a for-profit Star Trek film without a license, even paying himself a full-time salary of $38,000 a year.

I did hear about people accusing him of using crowd fund money to pay himself and crew wages. I don't know how true that is. Someone even said he was telling others that he was going to use the studio and equipment to make profitable projects. But why wouldn't he be allowed to use future equipment for other projects? If he took the money and used it all to buy himself boat then I would be unethical crime. But I haven't seen anything to support it. It all sounds like rumors. But I find it odd why CBS didn't sue them for that instead of this nonsense about looking too much like Klingons and Starfleet ships, and weapons.

I think using the Croudfunding to essentially make money might be a problem. If it was an original indie story, as in not associated with any established franchises whatsoever, might not have been a problem. But the fact that this was done under a Star Trek product that was NOT licensed by CBS... that's where the problem came in. As Star Trek belongs to CBS, any project that makes money would have to be working with CBS in some way. Axanar was not and apparently crossed a line.
As for the nonsense... from what I know CBS slapped them with a lawsuit and Axanar countered by saying it wasn't specific enough. So... CBS got VERY specific.
