Yeah, C/P is definitely not going to let Peters get any money off of this.
And if CBS/Paramount clean him out in damages, he's going to have a hard time refunding the kickstarter supporters, so will be lined up for a class-action/convention lynching ;)

Well, the good news for Peters is if C/P has their way, it will most likely include barring him from any and all Star Trek Conventions. So he is probably safe from any lynchings.

Class-action might be another story though. :o
Exactly... And if he goes bust in the CBS/Paramount case, he's not going to have the funds to settle a class action... That might have additional consequences...

He will have like 2 options, the way I see it....

    1 - Bankruptcy.
2 - Sale of all personal assets to the sum needed to cover the debt.

Given all he has done. You will forgive me if I don't shed a tear that Alec Peters is basically up a creek with no paddle (and in a leaky boat at this point). The man let his ambitions get away from him, he got greedy and he has no one to blame but himself.

Exactly... Had he done what he claimed to have set out to do (a Star Trek fanfilm) then yeah, all would have been good, but like all scammers, he played on people's goodwill and generousity, so I have zero sympathy for him whatsoever. I know some loon dressed as a Tribble once shot Claudia Christian with a starting pistol at a convention... #JustSaying

Usualy you can find a lot of fan-made stuffs in developing countries (China) :D
usualy they are made by the same manufacturer,
assembled by the same tiny quick hands ,
rolled out from the same line.

When the overall "production processes" are at a "professional" level
Those are called "clones" and not "fan-made" lol

    Some just called them piratesss

    arrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr

Just like Captain Barbossa he said he was privateer in service of the Crown.
All dressed up with makeup and fancy talks... Nay this and your majesty that.
    The fat King believed him

Don't compare Chinese 'manufacturing' to Alec Peters... It's an insult to Chinese 'manufacturing'... ;) Every watch I've ordered from China, has always arrived in the promised timeframe, been as described, done the job required of it...

Did you know that the reason why Chinese factories are producing those goods, is because the original companies out-sourced production there to save production costs and increase their profits, and the factories which provide the officially required parts, simply produce surplus which then goes into the 'other things'? If it wasn't for the greed of the original company, then the counterfeit market would still be at the level of crude and inaccurate copies which almost kinda ish look a bit like the real thing but still identifiable as not-original, not at the 1:1 level which existed say, six years ago (before the companies started getting scared by the counterfeiting and started coming down heavy on the outlets)

If those original companies produced goods at a reasonable price, rather than an artificially inflated one, then while there would still be a demand for their goods, everyone would be able to afford them, and there would be no call for counterfeits... Supply and demand at its most basic...

So no, Alec Peters should not be compared to them, because he just dangled a product, then scammed all the backers by using the money for his own ends... The sellers who tried similar tricks in the watch-collecting community were always quickly identified and ostracised, the ones who did good business, were successful... ;)

    This just in:
The Judge 100% unequivocally DENIED the Axanar Motion To Dismiss:

    https://lookaside.fbsbx.com/file/Paramount v Axanar 2-15-cv-09938 CD CA 2016-05-10 43 Court Order denying motion to dismiss.pdf?token=AWw_UpkgztWVwoyZdjnfIxbdswPwZV7KB-pZq-nUfC-CGmliT5h9-8BWt21i7eYy5XK7_zBSE-Vj_eQBEios1Kibv77GzIZHgLdkuHXEKCJFB12SPI2xzve8pFWOLm2e_l9zyR8wCRyj80Zh0Nnf6s0IzUfn8U4bbK13An3WC2MWRw

as well as the Klingon Language Society Amicus brief filing:

https://lookaside.fbsbx.com/file/Paramount v Axanar 2-15-cv-09938 CD CA 2016-05-10 42 Court Order denying LCS motion for leave to file amicus without prejudice.pdf?token=AWzwGOhZWtUxkMon6_zhMdhABrpeAtOYF9pWGY5I7tkYQUeMpLwa3dtzZ5oghC7u6m8ZfZqtJqXFme89WuDL_X1qm6HF7JDVCIst_lk3pX1hLuWI9m4Hu8R0-D0t6EtD84vF0nEmP3vUhpn_0DmqD7UhjzwJ-_I54Gs4S1VAcEeBWg

IMO - the best portion of the Axanar MTD dismissal:
"Although the Court declines to address whether Plaintiffs’ Claims will prosper at this time, the Court does find Plaintiffs’ claims will live long enough to survive Defendants’ Motion to Dismiss. For the foregoing reasons, the Court DENIES Defendants’ Motion to Dismiss."
    ^^^
[If you read the bolded (by me) parts - IMO It seems we have a Judge with a sense of humor and maybe a little irony here ;)]

Bottom Line: If some people were somehow believing this wouldn't in the end be a pretty open and shut case with C/P getting a Judgement in their favor at the end; the above should demonstrate pretty clearly the Law is with C/P and Axanar is about to get a real schooling in how Copyright works in the U.S.

Ok, That judge is in totally in my top five. Still no Judge Judy, but a very close second.

Sounds like Alec Peters is about to get smacked big time.

    Alec Peters, one day ago:
    Good Monday morning Fans!

Erin Ranahan, Andrew Jick and I just left the Los Angeles Federal Courthouse and I am happy to say our trial got moved up to January 31, 2017. So that is 3 1/2 months sooner than proposed by the parties.

That means, we could win this case and have Axanar back in production in March, 2017, Yes, we will finish Axanar!

And we should be hearing in a few weeks on Judge Klausner’s decision on our motion to dismiss. And despite a certain conspiracy nut’s claims, we expect to win at least part of that motion. (My money is on the judge dismissing at least the claim against the film Axanar, since we haven’t even begun production and so you can’t even judge a fair use defense).

Interestingly, the Judge only had two scheduling meetings on his docket and had cancelled the TEN or so hearings he had on his schedule. As Erin pointed out, this is SOP for Judge Klausner, and shoots down another crazy conspiracy theory by the same conspiracy nut.

So stay tuned for more info! With Mike Bawden flying to L.A. for planning meetings Thursday, we should have some interesting announcements in the next couple weeks.

    Alec Peters

What a dumbass. Makes the judge's decision (less than 24 hours, and a complete DENIAL of the motion to dismiss) even more hilarious. Peters is far less chipper on the blog today...
This morning Judge Klausner denied our Motion to Dismiss stating in part:

”Although the Court declines to address whether Plaintiffs’ Claims will prosper at this time, the Court does find Plaintiffs’ claims will live long enough to survive Defendants’ Motion to Dismiss. For the foregoing reasons, the Court DENIES Defendants’ Motion to Dismiss.”

Winston & Strawn will now prepare our answer to the amended complaint, which is due in 14 days.

In the meantime, we continue our efforts to settle this matter with CBS and Paramount so we can move forward with telling the story of AXANAR in a way that satisfies both the studios and the over ten thousand fans who financially supported our project.

The trial date has been set for January 31st, 2017.

You know, people don't expect judges to be snarky, as if you wouldn't expect somebody who is very intelligent and has a very frustrating job not to get snarky. I do, and I love listening to legal snarks even if I don't agree with the judge.

This is interesting. He's declining to rule on whether you can copyright a language; rather he seems to be dismissing the issue as largely irrelevant to the case.

This is how he should answer it, IMO. G&T Show continues to kill it, in the breakdown of this case... and they have continually said that the language issue could get upheld completely, and Klingon could become public domain... but, it still doesn't clear the other very large hurdles, LOL. They compared it to facing a 700-ft. tsunami (with the Klingon language intact), or a 675-ft. tsunami (without the language).

It's a distraction, and not worth *this* court's time. (I think he leaves the door open with the "without prejudice" part, but it's gotta be in a separate case.)

BTW, @starswordc... I like that sig pic, LOL.

At this point I think he is just spinning PR. He is trying to show he isn't scamming people out of their money by stating that he still plans to make this movie. He has gotten really good at the "Poor me, I am just trying to please my fans and evil CBS/Paramount are just out to get me"

Too bad for him, most people are buying it. Peters has been exposed, and deserves everything he is getting.

Well some people sure woke up on the wrong side of their beds this morning... I already knew about the legal issues, but I wanted someone that knew more than me that has been keeping track of it to share. You might find it difficult to believe, but my comment was genuine. The snide comments and gifs weren't practically helpful or warranted. For veteran posters you don't come off as welcoming. Certainly wouldn't consider it good first impressions either. Hint, be more kind to new comers in the future. You might make more friends that way. :D

Thanks marcusdkane for your input, it's really unfortunate it's not going to be produced. It had great potential and seems like a waste that it won't see the light of day. And it's kind of disheartening to see petty and legal squabbles destroy creativity over money. There are far worse things happening in the world that some people seem to forget. :(

Also before 'people' start accusing anyone of not reading. I did happen to read the linked article in the first post before commenting, but I was hoping someone could update me quickly without reading a total of 32 pages of posts.

I think it is wrong for CBS to wait until the last minute to decide to sue a company on the basis of fan film looking too professional. How long before it becomes widely acceptable for companies to follow suit and sue people on the grounds of "copyrighted elements and distinctive costumes" Sounds like they are grasping at straws and if they succeed, I expect all crowdfunding fan films, art, and literature to be sued and forbidden in the foreseeable future.

That's just my perspective on the matter, I am sure others have theirs.

Sorry we snapped at you, it's just your post honestly did come off as clueless considering what we've spent the better part of thirty pages talking about. This isn't a "petty legal squabble": Alec Peters' own financial documents (linked earlier in the thread) state he went way past making a fan film and was basically making a for-profit Star Trek film without a license, even paying himself a full-time salary of $38,000 a year.

If you're interested, somebody set up a website to track the case, axamonitor dot com. (For some stupid reason the forum doesn't want to let me link it right now.)

BTW, the BBCode/TextEx thing seems to be a problem with the forum software's mobile interface.

Thank you for the apology. I guess it does look like that. But if I was Omniscient being I wouldn't have asked such a gullible question. I didn't intend to come off as party crasher or troll, I always read the title and first post and the others if the post is new. I didn't know it was a requirement to read everyone of them.

I did hear about people accusing him of using crowd fund money to pay himself and crew wages. I don't know how true that is. Someone even said he was telling others that he was going to use the studio and equipment to make profitable projects. But why wouldn't he be allowed to use future equipment for other projects? If he took the money and used it all to buy himself boat then I would be unethical crime. But I haven't seen anything to support it. It all sounds like rumors. But I find it odd why CBS didn't sue them for that instead of this nonsense about looking too much like Klingons and Starfleet ships, and weapons.

Oh I don't understand the problem with the BBC code. Maybe it's because I am new. I can't seem to edit my posts either. Not very good start, lol.

I think using the Croudfunding to essentially make money might be a problem. If it was an original indie story, as in not associated with any established franchises whatsoever, might not have been a problem. But the fact that this was done under a Star Trek product that was NOT licensed by CBS... that's where the problem came in. As Star Trek belongs to CBS, any project that makes money would have to be working with CBS in some way. Axanar was not and apparently crossed a line.

As for the nonsense... from what I know CBS slapped them with a lawsuit and Axanar countered by saying it wasn't specific enough. So... CBS got VERY specific.

Oh ok, so they have financial documents that proves he was making profit from Star Trek. It confuses me why CBS didn't open with that instead?

I believe starsword mentioned something about that...
