When someone lies in ways which can be debunked in seconds by anyone with internet access, said liars need prosecuting to the full extent of the law... JJ Abrams and Justin Lin threw Alec Peters a lifeline with their intervention. He's basically spat in their faces, set fire to the lifeline, and gone back to sawing the branch while he's sitting on it... At this point, he deserves whatever the court throws at him, and that's not taking into account the fans who will be wanting their donations back when it becomes impossible for him to make the movie they supported...
I think this is why Abrams comments irk me so. It shows a complete lack of knowledge of the particulars of this case, Thus making it rather unprofessional. It makes him sound like he wants to be some white knight just so people will like and see HIS movie (and before anyone jumps on me, regardless of how involved he is or isn't with Beyond, Bad Robot is still producing it. So he is getting money from it one way or another). It just comes off as disingenuous, especially since he flat out said in commentary on Star Trek 2009 that he was not a fan of Star Trek and didn't see the need to be. Does anyone else get the feeling that Peters' legal team are advising him to do something this mind-numbingly stupid?!
At this point, Peters is either not listening to his legal consel, or he desperately needs a new one. When I as a random citizen with legal knowledge from the "University of Google" can tell this is ill advised, over someone who ACTUALLY went to law school and passed the state bar exam, you got to wonder what the legal team is doing.
I like the part when Ranahan debunked the claim of "ancient Vulcan letters" on the robes. Chinese lettering, ha! Wish I could see the executives faces at CBS/Paramount.
This is Vulcan caligraphy, not any form of Chinese writing...
I guess CBS/PARAMOUNT better get their lawyers to work translating their copyrighted language.
Anyone want to help translate for them?

Granted, I could be wrong, But my understanding is they don't have to translate anything. They just have to prove it is NOT chinese and is in fact the vulcan script they created for Star Trek. What is your point exactly?
It is as ridiculous as complaining about a alternate Klingon makeup and costume. Then we have to remember this about copy right infringement. How long before they sue Star Trek Continues for the very exact reason.

How are they going to prove it? It is as ridiculous as complaining about a alternate Klingon makeup and costume.
Same way Musicians prove someone did or didn't copy a song. You stick the script in the Vulcan scene and compare it to chinese writing, then compare it to Vulcan script from the Star Trek Franchise (most likely Enterprise).
Just like was done in this thread. Granted it doesn't have the wait of the court, but I think it is pretty clear which is similar and which isn't.

They won't.
Because Mr. Vic Mignogna is quite aware what the rules are and has been extremely careful to follow them...
*Like NOT Making ANY Money during the process and airing his episodes for free on the Internetz.
*Indicating on all his projects that Star Trek is a property owned by CBS/Paramount.
*He has actually created full episodes with his own money and some fan donations.
*He's also not trying to build a production company using CBS/Paramount's IP.
He has also been advised by CBS that what he is doing is in compliance, and therefore not a problem as far as they are concerned.

How to do it right, when handling someone else's IP.
Much like the Klingon language issue, this is a distraction from the bigger picture. You're attempting to reduce the irreducible.
If the calligraphy on that costume matches the calligraphy discussed here, then it doesn't matter if the Vulcan language is represented by Gene Roddenberry's hand giving "the finger." Vulcans have been presented, in canon, as wearing robes with that styling on it. Axanar is attempting to recreate Vulcans, as they appear in canon. THEY CANNOT DO THAT.

what most people think of as Chinese is on the left, and Manchurian is on the right. It's not that close though, but like Vulcan it's written top to bottom.

Or maybe it's because they can't deal with multiple lawsuit cases because of money AND it's far more easier to scaremonger other fan productions into not pursuing crowdfunding. That and I heard Continues is struggling to reach it's goals. So maybe CBS/Paramount is happy to see it slowly die off.
And I thought CBS/Paramount were in the middle of writing the rules.

what most people think of as Chinese is on the left, and Manchurian is on the right. It's not that close though, but like Vulcan it's written top to bottom.
Quite true. Vulcan has much more fluid lines and Manchurian simply doesn't have spirals in it.
Exactly. The only real similarity, is the orientation in which they're written. Written Vulcan has always made me think of musical notation...
And in any case, China isn't the only place on Earth which has presented language in that form. It can be seen all over continental Asia (Japanese, as I understand, is presented horizontally like western languages, but is read from right to left rather than left to right). In any case, there are no symbols on those robes (that I can see) which match actual mandarin or manchurian characters.

They're in the middle of writing officially published rules. Early on in Continues' production, CBS gave Vic Mignona a set of guidelines to follow to steer clear of litigation. CBS have even stepped in for Continues after YouTube pre-emptively blocked a number of their videos (basically saying that CBS weren't looking into taking down Continues' videos). CBS definitely aren't looking to kill Continues off. They've had plenty of opportunities and have instead supported Continues.

The linguist who oversees korsaya.org, is a linguist who has developed the written Vulcan language (words from the Vulcan Dictionary) to the same extent as Marc Okrand developped the Klingon language. He also did language work for JJ on if not the Vulcan scenes in 09, definitely the Klingon language in Into Darkness...
Thank you for proving the point that Axanar was indeed using written Vulcan, not any form of Chinese... You've well and truly proven the depths of dishonesty that Alec Peters will stoop too. I sincerely hope Diana Kingsbury dumps his TRIBBLE, because she can definitely do better, and deserves to be with a partner who actually be trusted to tell the truth. Someone who lies in such penetratably transparent ways, will quite likely lie about anything, and simply cannot be trusted to tell the truth...
It is as ridiculous as complaining about a alternate Klingon makeup and costume. Then we have to remember this about copy right infringement. How long before they sue Star Trek Continues for the very exact reason.
Daveyny's beaten me to explaining that one... CBS went to bat for Star Trek Continues when YouTube pulled an episode because they (YouTube) thought it was a copyright violation... CBS got the episode re-listed... It is no exageration to say that CBS approves of Star Trek Continues.
Also, to try and say "Well they're doing it too..." is not a defence for Axanar. Star Trek Continues have not set up a for-profit movie studio on crowd-funded money... Star Trek Continues makes no profit... That is why Star Trek Continues is not being sued, but why Axanar has been sued... (in addition to the proximity to Beyond and the new series issue we previously discussed

Prior to the Axanar case there were unofficial rules. Nothing written down, but more of an understanding of what a fan production could or could not do to avoid the ire of C/P. Now, they are officially writing down rules, which will no doubt put Axanar on the "Don't" side of the arguement.
As for Star Trek Continues. Given that you tube pulled them for a bit because of their copyright policy, and it WAS the intervention of CBS on STC behalf that got them relisted, I am fairly certain they do not have a problem with them.
Even if they did. The law is the law and fan productions need to understand that they are allowed only because they are ignored by IP holders, not because they are entitled to make their products.
So why didn't they show the same support for Star Trek Horizons sequel? Are we just cherry picking the ones that are ok?

It's because they don't want official rules because they don't want competition. It is simply as that.
"Great men are not peacemakers, Great men are conquerors!" - Captain Archer" "When diplomacy fails, there's only one alternative - violence. Force must be applied without apology. It's the Starfleet way." - Captain Janeway #Support Mirror Universe I.S.S. Prefixes
Or maybe it's because they can't deal with multiple lawsuit cases because of money AND it's far more easier to scaremonger other fan productions into not pursuing crowdfunding. That and I heard Continues is struggling to reach it's goals.
For several reasons:
- The Axanar debarcle (ie paying money and seeing no end product) has made people wary(or at least warier) of crowdfunding...
- When STC did their first funding drives, they were on KickStarter, and they got a significant amount (I forget how much without checking, and I can't be bothered to check, as it's not really relevant to this discussion) They went over to Indigogo, which only has about a third of the traffic of KickStarter. They also asked for a higher amount, so as to finish off the Five Year Mission. That they were asking for more money, from a smaller audience, is a significant reason as to why they have not met 'that' target. It's certainly not as simple as saying: "They're struggling to reach their goals..." because there are some pretty simple but significant reasons why that is so...
And I thought CBS/Paramount were in the middle of writing the rules.
CBS/Paramount don't need to write the rules on making profit on someone else's IP, because those statutes already exist... As was explained in the pod-cast which I first referred you to, CBS/Paramount were previously reluctant to specifically write rules, because the second they do so, they are immediately impacting and potentially limiting their use of their own IP through said guidelines and rules...
Many parts of the Axanar Defense teams response won't hold up as a defense because it's all basically the same arguments they used in their Motion to Dismiss that the Judge denied 100%. If you want the HEAR part of what was included in the defense response - a group of fans read the part where the Axanar legal team talks about Alec Peters degree of 'Star Trek Fandom":
http://traffic.libsyn.com/trekgeeks/TheBalladOfAlec.mp3
(the fact that this was even put in as part of the defense response shows just how desperate Erin Ranahan must be; as I suppose she's trying to say "He's such a big fan he should be entitled to make his fanfilm.." because honestly, I can't see WHY a lawyer would include something so ridiculous.)
It also makes his 'Propworx' company history relevant (IE C/P could now bring in the facts regarding the Propworx bankruptcy; and other actions should they feel it would help rebut the defense claims about Mr. Peters.)
