There's 2 owners of the Trek IP. One owns the rights to the TV shows, the other owns the rights to the movies. Cryptic is working in cooperation with the TV show owners so they can use things from the various series, but using things from the various movies is more problematic.

Cryptic would have to strike a deal with Paramount to use anything from that universe.
Actually, if CBS were to create a new TV show, Cryptic would probably have to strike a new deal to use that also at this point.
I'm kinda-sorta hoping that something like that happens, cause then PWE/Cryptic might consider trying to acquire the rights to JJ-Trek at the same time.

I will be forever grateful that Cryptic do not and never will have the rights to the garbage scow that is the JJprise, so such a silly idea like this will never, ever happen.

My understanding is that at some point, CBS did get full rights to TMP through Nemesis. When the game launched, Cryptic had to go through CBS to work out deals with Paramount. I believe the First Contact uniform, Sovereign, and WoK uniform were all free because it made negotiations easier (and the WoK code was bundled with a Paramount home video release). My understanding (could be faulty) is that when Cryptic negotiated its license (they bought Perpetual's actually but CBS had the right not to allow Cryptic to buy it and had to sign off on the sale), the terms there specified that anything originating in any movie was off-limits without negotiation. And when Cryptic renewed the license, by that point, the rights to TMP through Nemesis transferred to CBS and were included in the new agreement. It might have been possible (unlikely but possible) that the canon could have splintered had that rights split continued, resulting in a situation where CBS would have had to disavow the events of TMP through Nemesis entirely.
There had long been licensee issues with splitting the licenses even when Paramount had the whole thing. When Decipher did the card game, at first, they only had TNG/DS9/Voyager rights. At one point they were having trouble staying afloat and the license negotiations were tense. And they jumped to the interpretation that "Trials and Tribble-ations" and Voyager's "Flashback" gave them rights to TOS and movie era stuff from those episodes. Paramount reluctantly agreed provided it was ONLY things specific to those appearances. It's my impression that sales from those products allowed them to renew and negotiate for TOS and movie licenses.
Also: common misconception is that CBS and Paramount are rivals. They have the same owners in large part and when the JJ-verse movies use another character from TOS, it is my understanding that they actually have to negotiate with CBS. The comics are jointly licensed by the two which is why you can have things like Q running around the JJ-verse and taking Kirk forward to meet JJverse Sisko and Dukat. Likewise, Paramount's reps have some veto power over what CBS can do. My understanding is that up until fairly recently, Paramount was saying "no" to live action Trek of any kind (but did support and encourage CBS to continue the prime universe and the Bad Robot guys -- who get a vote -- enthusiastically wanted an animated Prime Universe Trek series. But CBS had no interest in making one. But they were only willing to approve an animated series at the time.) Cast members want to make something as well but can only make fan films without support (and Tim Russ has been making fan films with casts full of Trek actors). Dorn has been pitching repeatedly. Pretty much everybody except Stewart and Wil Wheaton have expressed some interest in coming back for something. Actually Wheaton would (and has; he did voice work for the 2009 movie), just not as Wesley. Spiner has actually softened and suggested he'd do voice work (probably not cheap) at various points but has no desire to do the makeup, which got progressively more involved to reverse his aging. Avery Brooks was once against a return but has occasionally seemed more open to it if it's a social justice oriented story... But he has a lot going on that could interfere with his ability to return.
The funny thing is, if anybody would just say, "We're going to make an anime-style series about Worf", you would probably be able to make that happen if somebody wanted to broadcast it and was willing to order it to series. CBS seems to want something new and not animated. Paramount wants CBS to stick to animated and Simon Pegg wants to focus on new stories. Netflix wants Enterprise. A majority of the actors want to reprise their roles in some form and some are actively doing that in fan films or showing up at conventions in costume and in-character. (I have heard a funny story that Garrett Wang used to even turn up at the now-closed Vegas Star Trek attraction in uniform and in character and that he's told stories about how he was booted out of the attraction for interrupting tours in character.)
CBS has taken pitches from a few people (including Brian Fuller, the guy who owned the Star Trek Forever website, and -- rumor has it -- Geoffrey Thorne of The Wire who played Jake Sisko in a machinima test video I did). But CBS needs Paramount's approval to go forward with those pitches I think. The bulk of the pitches take place after STO. The bulk of what I've seen (which may not all be solicited pitches) generally have common elements:
- A Kirk descendant/cousin (often female) well after STO's setting.
- A loss of technology/resources after a war which collapses/shrinks the Federation.
- A change in how the Borg operate
- Ferengi having purchased/acquired a genetic modification technology that has transformed their race into something visually intimidating but which has left them somehow diminished as the servants of a higher power. In more than one pitch, the Ferengi have been transformed into monsters by an outside force that has also made them pawns.
Meanwhile, Netflix really wants to bring back Enterprise, supposedly, and keeps trying to negotiate for a miniseries/12 episode season series revival. Apparently their viewership stats suggest Enterprise found a large new audience on Netflix and they REALLY want to bring it back. Supposedly one advantage is also that Enterprise is part of the backstory for both timelines, which allows any Enterprise project to straddle the fence. (And as far as I've ever heard, the idea that Enterprise was a holo-program is purely a fan theory and nothing but the last episode was. And both CBS and Paramount consider Enterprise to be the backstory for both universes.)
While I would like a Alternate Constitution class star ship in the game I realize that it may never happen. I however would like to see a refit or new version of the connie at T6

It's just some Wallpaper I found on the internet a long time ago that I liked. I remember toying with the Customization to see if I could make a Connie-refit look a bit like the above, but I think I would need to begin with a TOS Connie and just play with the Nacelles. Can we even do that i.e. change any of the parts on TOS Connie?

Back in the '80s it was one of the ship options of a Star Trek game, Star Trek: Starship Tactical Combat Simulator (played with pen&paper and dice. I know, that just crazy, right? ). Of course, the above image is a pre-refit version CGI-ed by The Red Admiral. In the game, the Loknar had TMP Refit look. All this about 30 years before the NX-ENT was conjured up for television. Okuda once said that game was the source of many models conjured for Next Gen and on.

That second image is a reproduction of the concept art for the Enterprise when they were looking at making Star Trek Phase II, which morphed into TMP.

Nope. I'm with CBS on this. NO T6 CONNIE....EVER! At the end of it's time, the Constitution Class was sold off or placed on border patrols, mainly as it's current space-frame couldn't accomodate all the 'then' new technology was coming in. Even though at the time it was classed as a Cruiser or 'Battle-Cruiser' (Klingon ref), compared to the Cruisers that are around now, it's woefully tiny and underpowered as well as being 'inefficient' in design compared to the sleeker craft that are around. You would have to 'up-scale' the dimensions of the Connie, just to even bring it upto spec for the power requirements.
