It's not just Tomm, any boss fight that somehow isn't perfectly in sync with your rotation will lower damage output significantly unlike other classes. Agreed, Crusader is a tier 3 Nightspine reward that previously was better then the Ribcage for many builds. The boots are at least still usable, you need stats from somewhere and the bonus is a bit more reliable then the one from the armor.
You're right, although it might be harder to cap with new helmets and chest pieces in the future if they give damage boosts instead of percentages. I'd definitely consider augments on some of my characters (which aren't close to maxed) if they at least gave percentages to main stats though.

Yeah, I added not using the feat and just running forward so its easier to reproduce and notice what's going on. On Arbiter you press R1 all the time and often immediately use other powers.
The bug is you get respecced multiple times or at least twice on the _same_ loadout. Don't redo your entire loadout, just check if it sticks. Logging out and in like poisd2strike suggested might also be able to (hopefully) permanently fix it.

Last time I tested it reapplying after the duration ends usually works. If you start casting while the debuff is still up on the target it sometimes (or always?) doesn't want to apply.
