When I got my herc, it was not only to farm TT... In this case the OP is an epic moron. No where does PWI state that if you buy a herc you can solo anything. In fact they state that any money you pay is a donation not a purchase of anything and they can close down the game at any time and give no refunds. You do not own your herc. It was loaned to you as appreciation for your donation to PWI.

I don't have a herc yet but still saving for one, and no I'm not getting a herc to solo TT. You know they called the SoF/PF pack "Battle Pet Pack" for a reason. It's a "battle pet" pack.. Not "TT pet pack". b:bye0 -

I copied this list of veno's job's, from a sticky here at our forum
Basically a veno's job in squad is:
- Pulling/Luring bosses or mobs.
*note this as #1 in the list of what our job is. now genie's can lure, everyone has a genie, they don't need us veno's anymore for that!
- Keeping the boss debuffed with amplify damage (although don't use it when you know some bosses with nasty AOE can kill you)
*clerics also have these skills and genies do too!
- Brambling the tank
ohhh here a veno's job!
- Sending sparks to the tank or cleric (after cleric uses BB or RB)
ohhh here another veno's job sending people in the squade sparks! lmfao
- Purging the boss
and die doing it!
- DDing, of course
last but not least!
Those are player descriptions so they are irrelevant to suing PWI.0 -

I'm going to go out on the owls' limb then, and say this thread only remains on the main page because:
1) It is ridiculous (at least in the context that the OP gives it)
2) Stress relief for the mods & GMs who need a good chuckle, especially with all the other trash threads that have cropped up recently.
Personally I think it'd be hilarious if someone did in fact find legal grounds to sue PWE, but I'm not gonna hold my breath on that score.[SIGPIC][/SIGPIC]

OP, you made three mistakes here....
First, you posted in the forums run by PWE asking for advice on how to sue PWE. Obviously, had you actually received support and advice, I'm sure this thread would have been shut down, if it is not already going to be once discovered by a GM.
Second, you asked a gaming community for legal advice. Go talk to a lawyer or a professional in the field of law for legal advice. This community may have adults, but most of it is still made up of kids I'd bet, and the part that isn't, only an extreme few have an adequate knowledge of law to answer you accurately.
Third, you actually thought that a Herc was meant for only TT. Were that the case, you might actually have a legal position, as a product you paid money for no longer could perform it's task because of something the company did. Your Herc is a pocket knife you have been using to open canned goods with, but it was never made for this sole purpose, it just happens to be a bonus to having it.
You bought a Herc which has the purpose of tanking bosses, not any particular one though, and certainly not to solo squad mode TT with. There is a reason those bosses under any other circumstance require a squad to beat. If you are soloing them, then you have found a bonus. Just because PWE stitched that up doesn't mean you have a legal right to sue them for something you shouldn't have been able to do in the first place. Do you know why TT requires four or more people? I was only pointing out to the story being amusing. As we continued discussing on the thread it remains unlikely the story, as frequently told, to be even true at all...
And frivolous litigation is something we should all discourage. I say this without too much of a vested interest (in my country this sort of thing is usually laughed out of courts) but you should take a long look at your medical bills and ponder just exactly how much of that is going to pay for malpractice insurance... The Industry's current great power (we all know who) is slowly moving towards a subscription based model that supports RMT (that's a p2p with a Cash Shop) and many other games are following that trend. We may very well be at the end of the era of cheap MMOs and i am opposed to people that will one way or the other contribute to make them more heavily regulated (the US government has already tried once) and more expensive. Yeah, your consumer rights will very likely be protected in future games in which you'l be shelling $25 US a month to be owned by heavy CSers...0 -

I don't think I've EVER see a veno QQ about having a herc. So, first off, kudos there. :P
Secondly, and a more serious note, and the part where I become, I don't know, completely opposite? (Too late to think of the right terms.) If you were to bring up a lawsuit on your herc not being able to tank TT... Oh, do you need a check on that.
My main stress here is going to be... HERCS WEREN'T MADE JUST FOR TT!!!!!!!!!! In fact, a herc has many other uses than just TT. And don't get me wrong, I think it is simply dumb to make TT impossible, solo or squad, but really... There are plenty of other instances hercs can be used in. For instance, FBs, Frost, Lunar, lower TT runs, grinding, killing any bosses you need done, etc. The list can go on forever on what you can still do with a herc.
Simply put, as long as they didn't nerf the herc to the point where it can't take ANY damage whatsoever, your side of the argument is, to put it nicely, useless. Just because it can't tank one thing doesn't necessarily make it worthless and a waste of money. Besides, there's still other levels of TT that it can solo.Eshlay- Lv. 92 Venomancer (Quit/Retired)

I'm waiting for TT bosses to put a debuff on players that reduces your attacks to @APS if you're any faster. And then watch the QQ fly. "They didnt change 5APS weapons & gear, they just changed TT". Sorry that argument doesnt fly. When they put a specific debuff in place that specifically is meant to stop Herc from tanking (since every player tank can be purified, but Herc can not), it is a nerf on Herc, and not a "TT nerf".0

I am currently seeking legal advice on how about getting this started. I know this has been done with MMO's in the past one person recieved 30,000 us dollars from a gaming company that ran an mmo almost just like this one over he had spent a 1,000 dollars on his characters then they released a patch/update making all of the things he had spent his money for worthless.
It has been done and its not impossible even by their tos if they sell a product and the product has a specific purpose and it fulfills that purpose there isnt a problem but if they some how make that product not functional to its sole purpose by their doing the product should either be replaced or made to function as it was intended to at time of said purchase or refunded. i will update more on this once aware of how to get this started from legal aid.

1. My Herc tanks everything for me and I mean everything (BH, OHT, Quests), I rarely to TT runs.
2. Hercs arent worthless, my herc is my right hand man.
3. If you are just using your herc for TT then you are under utilising a great tank.

They added a debuff specifically targetted at hercs. One that wasnt present when people bought the herc. The herc lost some of its usefulness that was present when the hercs were bought. Guess what that means, herc owners dont have what they paid for.
What if they added an ability to TT bosses that makes all healing less effective? Well all of the clerics stats are all still the same, are you willing to say that isnt a nerf against clerics? Not all nerfs have to explicitely affect the stats of the thing being nerfed. Anything which changes the situation specifically targetting 1 indivual is also a nerf.
P.S. before you say it affects everyone around the board equally, Tanks of all types can be purified, Hercs cannot. The debuffs were much more specifically meant to Nerf Hercs ability to tank the fights. Also before you attempt the arguement that they were never meant to tank TT. Regardless, then they shouldnt have been able to from the start. They could, for 2 years. If they never could from the start then thats one thing, but they changed the rules after milking many many Venos of their money under the pretenses that they could.0 -

I agree with you here. Also, I think there may be more consumer protection here than we we would assume. If you have actually spent a reasonable amount of money... as in a sum greater than an average of what pay to play, subscription based games would charge, you may have standing. Without researching either code or case law I won't pretend to determine if there is a case to be made... Precedent is created out of a need to fill the void where the laws don't expressly cover specific problems that previously did not exist. And, I know there are a whole slew of really screwed up and complicated consumer protection laws. I just can't be bothered to study that mess for a meaningless discussion on class action suit thread concerning a game I play for recreational purposes. lolI post in forums. This one and others. I want to help my friends out with all kind of stuff... With a herc I can be a better help due to I can tank bosses in TT when needed but also bosses in some BH's... Or other bosses they need help with.

i was farming tts with my firends (BM and Cleric) and we payed for our gear 2000$+ only to farm tts, pwe never stated that our gear are only for farming tts.. but we could do it, and now we cant.. so we are demanding that they arrange this game as we think it should be.. and further changes from their side are forbidden until we approve them..
they didn't tweak our gear or wpns.. but hey, they have no rights in doing something to the instances that make them harder.. they are only allowed to make them easier..
so, our suggestion is to make those instances doable by our squad coz we spent more than 2k$ on our chars to do something we cant do anymore..

When you applied to PWI and you signed up and you checked the "I have read and I agree by the TOA" (Different wording, probably).
Now if you take the time to actually read what it says, you will notice that they can not be held responsible for different game experiences. And also, it doesn't matter if you spent 5,000 dollars or 10 dollars in the game. If the game changes and something becomes less useful there's nothing you can do about it but QQ (Congratulations, you're doing that pretty well)
My point is that "I've head this guy sued bla bla for bla bla and got bla bla" is either fake rumors or it has happened a long, long, long, long time ago when MMO's just came out. Mistakes like that took place, but over years of development.

"We can ban you when we want, we will not refund your money and we are not responsible for how you experience the game due to patches/changes. If you don't like it, quit"

Precicely.. I once read an article about a person who got permabanned from a certain $15/mo mmo because he was supposedly "botting" when in fact he was using a programmable gaming keyboard with macro keys, which at the time had just hit the markets.. long story short he had payed for his playtime a year in advance (for a decent discount) and was banned only a few months into the year and was not refunded, when he tried to sue for his money back, he was somehow found to be violating some section of the ToS (which has since been rewritten a hundred dozen times), all he got out of his ordeal was a hefty legal bill and nothing else.
Fighting a big (or even semi-big) company for whatever reason is often pointless and will take forever, your money will run out long before theirs will, and/or they can and will find some loophole in the very craftily and carefully worded ToS to use against you.
Now to save myself some headache i'm not going to comment on the op's reasons one way or another, but i will say i forsee lower depths or off-topic discussion in this threads near future.
