By that argument, every single MMO in existence is in a constant state of beta.
What is that letter L next to Neverwinter? Use the brain you so clearly misuse and glance at the legend at the top.

Nitpick all you like about definitions and the like, search desperately for definitions online where some ones opinions suits yours but in the cold light of day on their own website they chose to put an L next to it, look carefully ....there are other options for the various Beta's. they put an L.
Didn't have time to read everything, and don't know if it had been said. The real money transaction is buying Zen, a virtual currency. The transaction takes place between PWE and the consumer. It has a separate T&C, and is independent of whatsoever contractual obligation of releasing a game.
I believe that the obligation of the dev on fully releasing a game contains much more constrain when a money transaction is involve, primarily on the product quality. So by remaining in beta & not charging a purchase price/fee, I think it would allow the game itself to side step a lot of legal obligations... The zen part is a totally separate issue.
This is a released game. They even had a launch. A 5 day head start for paying customers for an open beta is unheard of. A 5 day head start for a game that is launching is. They also stated that there will be no further character wipes. If this was actually open beta, then there would be a wipe at the end of the beta. Then possibly a 5 day head start for founders and so on.
Please stop falling for the PR departments line of steaming excuses.

An existing, in-game exploitation for over two weeks that literally thousands of users have been abusing while getting a ticket two weeks later from a GM saying "thank you for your time we'll look into it" is unacceptable. As far as the "beta" is concerned, multiple gaming companies, such as PWE, have been using "open betas" as a soft launch. A real beta would role back all progress made on the game's release, as has been done in the past with countless games. The only game I can recall doing that recently was Wizardry Online, both for the closed and open beta, they wiped.

Food for thought:
1. The beta forums were removed just prior to "Open Beta".
2. The Drow race will be released 60 days after "Launch". Should be interesting to see what happens 60 days after the start of "Open Beta".
Also, terminology tends to be somewhat organic and will change over time, so relying 100% on a strict definition is somewhat silly. Especially when marketing types feel free to change things whenever it suits them. What is rather telling is that none of the major gaming sites are accepting this as a true beta anymore.
So by your post we are all here to test and report bugs in Neverwinter, right?
So why the hell are we being charged to respec our characters? Wouldn't you think they would want as much feedback they can get on all the different combinations?
This was done in Pre-Alpha/Alpha/Closed Beta, with lots of feedback and community interaction. They're testing other things now.
This game's OBT is in much better shape than others I've been, most recently RaiderZ, which was an unstable disaster.
Beta or not this games ruined. It's lost its player base and destroyed its economy because they refuse to wipe. pointless to discuss further
