Because the two factions facing off in the cold war use proxy wars and minor countries/species to "fight" each other. Same thing happened between the US and USSR.

I can see it now: Roll a new character that acts as a temporal agent from the 23rd century. Grows up fighting with Kirk and the Enterprise, gets recruited into the Temporal Cold War with access to the 24th, 29th and 31st centuries. Can travel through time almost at will.

Mine also still requests the patch. I have restarted the launcher and my computer multiple times to no effect.
