Is this a Bug or By Design (TOS Era Captains Reclaiming Ships)

Ok the other day I made a new TOS Era Captain and Finished the Tutorial and tried to reclaim the Gagarin Miracle Worker Battlecruiser, however noticed you can't reclaim it (among many other ships) until you reach the 25th century, however the C-store ships I could reclaim is the C-store Walker and the Jem'Hadar Vanguard Ships. So got me thinking, All but 1 Discovery Era Ship can't be reclaimed when your in the TOS Era, but you can reclaim a Jem'Hadar Ship, is this some kind of Bug

Kinda makes sense if you think about it. TOS, DSC & JEM are in a kinda "factionless" state until they hit a certain point (reaching 25th cent. ESD for sub-feds and choosing a faction for jems).
The vanguard ships are supposed to be playable right of the bat by jemmies and the walker is supposed to be playable right of the bat by disco feds. So they would be coded to be playable by these "factionless" characters which would lead to that result. Based on this my guess is that even roms can use the vanguard ships before they choose between fed & kdf.

Should also point out that I can't reclaim the Cardassian Intel ships either
