Restricted from getting T5 Tempest Patrol Escort Refit

Is all 23rd Century characters restricted from obtaining ships from the Zen store? If not my 23rd century character is on the T5 Tempest, but not the other T5 zen store ships. Just a question whether or not something is wrong or thats just how it is, but I thought all Federation characters and 23rd century characters were allowed?

What level is your char? It only unlocks at level 50, sometimes even 51..
