No problem at all. Kickstarter is a great place for well developed ideas that just need a bit of a boost to become reality. A guy randomly waking up one morning and deciding he wants to use other people's money to turn a series of mods into a for-profit game...not so much. Hell, if you look at the reward tiers, backers won't even get a copy when all is said and done.

CBS has been pretty generous with fan productions and games in the past, Renegades had no permission either, and its kickstarter was never challenged. However, the plan for Renegades was that it would be pitched as a TV series and failing that possibly become a free web series. Sticking a price tag on there might test the limits of CBS's generosity.
I think the real question is Activision, though. After their lawsuits with Viacom and hissy fit, they basically said they were going to hold their Star Trek titles hostage until they got all that money they were never due to begin with.

As you say, there is a fundamental difference between producing a free to consume web series at fan expense versus producing a for-profit product.

While I did miss that, you'll forgive me for being as completely cynical as I am. The pitch can be edited at any time. Backer rewards are exceedingly difficult to tweak. Promising a backer reward in the pitch, but not including it in the rewards is a huge red flag.
While it could simply be that this guy has zero experience putting together anything resembling a professional proposal (compare his little one page snippet with say, this kind of a design pitch for example (full disclosure, I am a backer for the latter)), it's far from the only inconsistency on this project.

Bridge Commander 2 will be Free-to-Play once released, no subscriptions, no benefits for people who pay more, no in-game items to be purchased.
CBS HAS Granted us permission to pursue and develop Bridge Commander 2.

This would be great! They wont have Patrick Stewart or Brent Spiner in it like the original though.

They did'n even laugh... they just said "NO... NEVER".
