I would assume that CBS and Paramount had gotten together with JJ and hashed out a way so that CBS still had it's Prime Universe, Paramount had it's nuTrek IP and JJ controlled the story for nuTrek.
Cryptic have previously told a story about content they were planning for the Romulans before the JJ-movie while the game was still in development.
They got a call from CBS saying "We need to talk."
In otherwords, CBS had control of some rights in regards to the effects of nuTrek on the Prime Universe and as a result STO could use and be based upon those elements but what they cannot use and be based of is all the stuff that is restricted to nuTrek.
Whether the USS Kelvin as destroyed in nuTrek is legally CBS or Paramount, I can't say as 1. I'm not a lawyer and 2. Not privy to the contract between CBS and Paramount regarding these rights.

Let me spell this out for you as simply as possible: The STORY for the Countdown Comic comes from Abrams, Kurtzman and Orci. The comic book is a movie tie-in like those drinking glasses my friend got from Burger King. The writer of the comic worked for Kurtzman and Orci. The idea for the comic, and all of the tie-in to the film in that comic, comes from a meeting with Abrams, Kurtzman and Orci.
This is all hashed out in published interviews, hyping the film and the comic.
This game uses that story to introduce players to Star Trek Online.
That story comes from Abrams.

Do you have the contract? They might have signed that over. I'm relatively certain that Paramount would go for full rights to ship designs and costumes.
And CBS is in charge of licensed products for Paramount's Star Trek movies, apparently.
So CBS would be the ones to decide who can make statues, toys, action figures, and video games.
I think the big issue is that Cryptic hasn't paid to license any of the movie assets.
Luke planning to join the Imperial Navy was first mentioned in the movie.
The Hobus supernova was first mentioned in the comic.
Anything that's first mentioned or show in the JJ Abrams movies is the exclusive intellectual property of Paramount/JJ Abrams, and can't be used by CBS or Cryptic without expressed (read: paid for with money) permission.
Paramount/JJ Abrams do not like CBS, because CBS refused to stop selling merchandise from the original movies and TOS, so it's unlikely they'll ever grant permission to use JJ Trek assets, even for money.

I think the obvious things STO can focus on are:
- Alternate/expanded Caitian costumes, including hair, less fur?
- Section 31 Plotlines
- Perhaps Section 31/Klingon Intelligence/Tal Shiar ships similar to the Mirror ships
- Children of Khan
- Stun settings on weapons (note how nobody died)
- TOS excursion jackets
- The Cage Uniforms, with accompanying service hats
- Better short male haircuts (STO still doesn't have a lot between middle aged dork and young punk; people in STID have awesome hair)
- Better ground combat with more sense of gravity/momentum/movement and better melee. More types of environment interaction.
- Fighters/shuttles being usable in certain ground missions
- Improved pistols
- Language support and a Klingon translation parser, maybe?
- Undead Tribbles
- Playable augments. Caitian-esque jumping. Solid physical strength/accuracy. Good melee support.

That being said, w/ the exception of some of the characters (Nero, Adm Marcus), they are still the same characters from the show and earlier films that CBS ultimately owns the rights to.
I'm not an attorney, but professionally I deal w/ insurance contracts and can generally navigate my way through legal agreements; still, copyright and licensing law evades me. Is there a supremecy clause in terms of ongoing feature films? How else would the movie producers get to veto a new TV series from CBS? What would happen if Paramount/Bad Robot wanted to produce a show set in this new universe; could CBS veto that? What happens upon completion of the 3 film deal w/ Bad Robot? Will CBS regain rights to feature films at that point?
Regardless, consumers and ST fans miss out w/ split agreements and license holders that can't work together and "share the wealth" so-to-speak. W/ LOR coming out, a guarantee you a lot of people would love to be flying the Narmada. Instead, Paramount/Bad Robot would rather make crappy downloadable and co-op shooter console games w/ their license.

Keep in mind that Cryptic has Perpetual's license, and so must abide by the agreement Perpetual made with CBS when they bought the license back in 2004. Whatever was going on with CBS and Paramount at the time had influence on what when into Perpetual's license - and keep in mind that Perpetual got that license long before JJ was even offered a chance to redo Trek for Paramount, or that anyone had even thought about redoing Trek as a new movie series.
STO is about my Liberated Borg Federation Captain with his Breen 1st Officer, Jem'Hadar Tactical Officer, Liberated Borg Engineering Officer, Android Ops Officer, Photonic Science Officer, Gorn Science Officer, and Reman Medical Officer jumping into their Jem'Hadar Carrier and flying off to do missions for the new Romulan Empire. But for some players allowing a T5 Connie to be used breaks the canon in the game.
The Red Matter Capacitor, the Romulan facial tattoo, Zach Quinto voice over, Nimoy voiceover, the entire storyline being linked to the Hobus super nova ...

Cryptic may not be able to use the U.S.S. Vengeance that appeared in In To Darkness but they could Certainly use the fan submitted design that the U.S.S. Vengeance has many similarities with that Cryptic Already Owns the Right to.
If memory serves there was also a U.S.S. Vengeance referenced in a few of the old ST novels.
The bottom line for me is I think that Cryptic could come up with something quite similar to the U.S.S. Vengeance without having to bother with dealing with copyrights and permissions.
STO already has the Dreadnought Class and already has plenty of designs to choose from if they wanted to try to capitalize on the popularity that the U.S.S. Vengeance currently has.

I don't think they can make the Vengeance in this game.
I think they can make a dreadnought that is inspired by it. Or do quit a bit of what you say. It's a cool idea. People seem to really dig it. And it would be something there would be a lot of interest in.

It's just every one of these types of threads attracts some poster who's going to call JJ Abrams some version of Jar Jar Binks, and say that there is absolutely nothing of his work in this game, even though there's quite a bit since the game got enmeshed with the Romulan homeworld being blown up right from the get-go.
That's all I'm ever trying to point out. That this game already included JJ bits in it.
I'm also not at all annoyed by how many people liked the Vengeance and want to fly something like it in the game.
It's all about fun and I'm am convinced people find that ship to be something they could have fun with. So more power to them for asking for Cryptic to do something like it.
I think far too many people are just being a stick in the mud about this game. Like they don't ever want it to evolve past cap and hold in their Defiant or protect the Kang with the Excelsior.
I think one of the main problems from the viewpoint of the devs is the prospects for the Vengence to actually sell unless it were changed completely.
Considering the the J.J. Enterprise is basically a mutated version of the Constitution class, the Vengence would be a Tier 2 cruiser, at best, on par with the Exeter class. And not many people fly around with Exeter class ships in the end-game.
Even given that the Vengence has some direct similarities with the Excelsior (don't want to give out spoilers, but those who see the movie will probably note at least two direct connections), it's hard to know if the Vengence could be introduced in such a form to be profitable to the Devs without stretching it into just another reskin of the Assault Cruiser.
In short, I don't see the Vengence being introduced into STO because its place is already filled by at least three cruiser classes already, on top of all the legal work it would take (and the obvious hate that would be generated by many players for anything from the J.J. Trek being put into STO wholesale).

As near as I can tell:
There was a split on what CBS owned because of the Viacom split.
Paramount owned the movies. CBS owned the shows.
CBS owned promotional/product tie-in rights to both. Paramount had veto rights on what CBS can do with tie-ins to its movies but I believe CBS gets final approval from merchandise, including games, on J.J.-verse licensing. They don't own the Abrams movies but they get a merch cut, approvals, and are in charge of who gets product licenses for the movies they DON'T own.
Initially, I believe, Paramount owned TMP, WoK, SfS, TVH, TFF, TUC, Generations, First Contact, Insurrection, Nemesis, and Star Trek (2009).
However, when J.J. Abrams reboot devised the alternate timeline and made a lot of money, I believe they cut a deal with CBS to give CBS control of all the movies prior to the 2009 film, as the Prime Universe/Reboot Universe made for a cleaner way to split rights.
At one point, I believe Cryptic was in doubt whether they could use the Excelsior or the Wrath of Khan uniforms and had to deal with Paramount on a case by case basis for assets from ANY movie. Eventually, it was decided that it was cleaner for CBS to have rights to the old movies.
Even now, though, CBS has to be pretty involved in the Abrams films because they continue to make new references to CBS owned material.

Last time Cryptic let the fans make a ship it turned out to be a complete disaster.
Once again, even if CBS owns the rights to everything Star Trek, that does not mean Cryptic does. Again, consider "Birth of the Federation", which had a license that allowed for ONLY "The Next Generation" content, and nothing else. So, for example, they could include Trill, but had to use the "TNG" make-up design and could not use the "Deep Space Nine" design. Or, from another genre, "Lord of the Rings Online" has rights to the "Lord of the Rings" trilogy and "The Hobbit", but not "The Silmarillion."

all legal mumbo jumbo aside i really liked the film and thats coming from someone who loved Wrath of Khan. Yes i am a hard core Trekie but i also like the new stuff they are coming out with. just because its not conventional trek doesnt mean its bad. i just watch it as a new trek, kinda like i watch the new Batman films i still like Jack Nicholson as the Joker but i like Heath Ledger as well.

Actually, no. The Constitution in the JJ Universe is about the same size as the Constitution class in TOS. The difference is that you get to see it rendered on the big screen, so it -looks- larger because you can actually get an idea the size of a starship on that. Comparatively, the Vengence ends up being about the size of the Excelsior.
As for the power range of the ship, remember we are dealing with TOS level tech (or lower), so it's all relative to that. The Vengence is, indeed, more heavily armed than the Enterprise, but that still doesn't bring it close to the level of the ships in STO timeline. Again, Tier 2 at best, even modernized.
And the concept is already in STO. They are called Escorts

I think they can make a dreadnought that is inspired by it. Or do quit a bit of what you say. It's a cool idea. People seem to really dig it. And it would be something there would be a lot of interest in.
Without having to get into any licensing snafus.
It's just every one of these types of threads attracts some poster who's going to call JJ Abrams some version of Jar Jar Binks, and say that there is absolutely nothing of his work in this game, even though there's quite a bit since the game got enmeshed with the Romulan homeworld being blown up right from the get-go.
That's all I'm ever trying to point out. That this game already included JJ bits in it.
I'm also not at all annoyed by how many people liked the Vengeance and want to fly something like it in the game.
It's all about fun and I'm am convinced people find that ship to be something they could have fun with. So more power to them for asking for Cryptic to do something like it.
I think far too many people are just being a stick in the mud about this game. Like they don't ever want it to evolve past cap and hold in their Defiant or protect the Kang with the Excelsior.
Considering the the J.J. Enterprise is basically a mutated version of the Constitution class, the Vengence would be a Tier 2 cruiser, at best, on par with the Exeter class. And not many people fly around with Exeter class ships in the end-game.
Even given that the Vengence has some direct similarities with the Excelsior (don't want to give out spoilers, but those who see the movie will probably note at least two direct connections), it's hard to know if the Vengence could be introduced in such a form to be profitable to the Devs without stretching it into just another reskin of the Assault Cruiser.
In short, I don't see the Vengence being introduced into STO because its place is already filled by at least three cruiser classes already, on top of all the legal work it would take (and the obvious hate that would be generated by many players for anything from the J.J. Trek being put into STO wholesale).
As near as I can tell:
There was a split on what CBS owned because of the Viacom split.
Paramount owned the movies. CBS owned the shows.
CBS owned promotional/product tie-in rights to both. Paramount had veto rights on what CBS can do with tie-ins to its movies but I believe CBS gets final approval from merchandise, including games, on J.J.-verse licensing. They don't own the Abrams movies but they get a merch cut, approvals, and are in charge of who gets product licenses for the movies they DON'T own.
Initially, I believe, Paramount owned TMP, WoK, SfS, TVH, TFF, TUC, Generations, First Contact, Insurrection, Nemesis, and Star Trek (2009).
However, when J.J. Abrams reboot devised the alternate timeline and made a lot of money, I believe they cut a deal with CBS to give CBS control of all the movies prior to the 2009 film, as the Prime Universe/Reboot Universe made for a cleaner way to split rights.
At one point, I believe Cryptic was in doubt whether they could use the Excelsior or the Wrath of Khan uniforms and had to deal with Paramount on a case by case basis for assets from ANY movie. Eventually, it was decided that it was cleaner for CBS to have rights to the old movies.
Even now, though, CBS has to be pretty involved in the Abrams films because they continue to make new references to CBS owned material.

Cryptic has explicitly stated what they have rights to, and what they do not. This debate is pointless.
As for the U.S.S Vengeance it would be flipping huge next to any of the ships in this game. keep in mind that the constitution in that film is like twice the size of the Sovereign and the Vengeance was like twice the size of the constitution. I however would love ships inspired by the concept of the Vengeance. Small crew with lots of weapons and very bloody powerful.

Actually, no. The Constitution in the JJ Universe is about the same size as the Constitution class in TOS. The difference is that you get to see it rendered on the big screen, so it -looks- larger because you can actually get an idea the size of a starship on that. Comparatively, the Vengence ends up being about the size of the Excelsior.
As for the power range of the ship, remember we are dealing with TOS level tech (or lower), so it's all relative to that. The Vengence is, indeed, more heavily armed than the Enterprise, but that still doesn't bring it close to the level of the ships in STO timeline. Again, Tier 2 at best, even modernized.
And the concept is already in STO. They are called Escorts

Look at the shuttle bay in both JJ movies, and compare with the shuttle bay of the original. They both occupy the same position and same portion of the relative hull space in each ship. If anything, the JJ Enterprise is smaller. Interviews don't mean squat when you can tell that the shuttles barely fit into the JJ Enterprise, and the original Constitution had room for a rotation standby pad, as well as multiple control 'tower' stations with room to spare. And this is from both the outside and inside shots. The only reason the JJ Enterprise looks larger is because the original Enterprise was too large to survive landing on a planet, so you never saw it with people standing next to it.
Regardless, it's a moot point. We're not going to see either ship in STO, and there are comparable ships already in the game. Time will tell if they introduce a ship with some of the shape of the Vengence, but it will be a different ship entirely.
Shuttles in the JJ-verse seat something like 20 people though.
