You might want to check that. I didn't think Robert E Howard's works had passed into the public domain yet, mostly because Disney's lobbyists keep getting the US Congress to extend the limits on copyright. As far as I know, Funcom had to pay for a licence to use the Conan IP.

Spartacus himself was a historical figure... let's just say that some of the other NPCs in the quest were very clearly based on fictional characters created for the TV series, which most definitely do fall under copyright. You can probably get away with a passing reference to Hyboria (I've not played the new version yet)…
