It is a "released" open beta. Not a complete product, but a beta. As I have said before. You can still buy your way into a beta. It is no that unusual. And you can see it more like a pre-order then donation if you want. I am not sure what "legalities" you are referring to however. ToS?
I agree that the AH sucks. But there is no real duble dipping fee. There is a deposit when you put it up and a fee when it is sold. You will get the deposit back when you sell your stuff

If you pick the choice of 6 hours you are doing it wrong. It takes 10 min to make 2 low level craft materials. the 6 hour one is for when you are going to bed or going to be away for a while so you can't micro manage it. personally I like it. you can also spend AD to quicken it up if you are rich, or buy better level…
