I have since found that when I play my lvl 28 character they are not a member of the guild.
Is this a error or is this something that is how the game works?
If so then in theory my lvl 28 character could either join the same guild as my lvl60 or join a completely different guild?

Guilds are not an account-level thing. You can try to see if there is a command to invite a character to a guild, then use that w/ your alt's name - that works in Champions Online.

guild is character based not account based
log onto your level 60, invite your level 28, log into your level 28 and accept
