Why Isn't the PvP Instance Port Bug Fixed by now?

As of this moment it's incredibly hard to PvP as the chance you actually get ported to the instance is less than 50%. Not only do you not get ported, but if you're the leader you can't be kicked, kick yourself, or leave the group.

This is not a new bug. This has been here since beta. Why isn't this fixed yet?
