Are they bringing Foundry back? o.O

I was reading the Neverwinter/Gearbox ToS just now (last updated June 19, 2023 so it's up to date, find them here: https://www.arcgames.com/en/about/terms ) and I saw in section 13 they start talking about User Generated content and set out all the rules and legalities about this, and they mention the Foundry specifically by name several times. Does this mean they are considering bringing it back? I mean why would they mention something so old and no longer used in the game in a recently updated ToS document unless they were thinking of resurrecting it and wanted the legals taken care of ahead of time? Why mention it by name at all unless it has relevance in the present time? Because we sure know it isn't in the game currently and no part of it is either so there's no reason to include it in ToS unless they're considering it coming back. That would be cool eh.

    Probably not.

The foundry was mentioned by name even back in the 2014 version(s) of the ToS. It is probably present still in the ToS due to the foundry having been part of the game at one time and serves as a place holder.

It is a general Term of service. It is not a Neverwinter specific term of service. You cannot find the word 'Neverwinter' in it.

Yes but Foundry is not just for Neverwinter. Anyway, it probably is just a place holder policy for whatever Gearbox games may or may not use/publish.

If the foundry is the only part of any game here that has/had user generated content, then yes it would need to be specifically noted in the ToS.

I can understand it being there in 2014 because we had Foundry back then and it was relevant to the user experience and legal conditions of playing. But there is no reason to have it in there any more as all parts of it have been removed and it no longer has any effect on the player experience and for legal documents, they do not have placeholders as you put it, they would remove anything not relevant legally to the game each time they updated the ToS which was last done July this year. So I have to ask why is it relevant to the game today and why do they have a huge section on player-generated content and specifically refer to it by name as the Foundry, have you even gone and looked at how much info they have on the Foundry specifically? It's a huge section just for the Foundry. It's not just one mention buried in there somewhere. Gearbox is a new company operating this game and they would have done legal housekeeping and cleared out any deadwood in the ToS and removed things no longer relevant, so the fact this section is in there means something.

It is like Neverwinter does not have Mobile Software. Yet, it is mentioned in the ToS.
"Foundry" also is not limited to Neverwinter.

    Not necessarily.

If at any time user generated content is later added to any game here (or brought back in regard to Neverwinter), it is already noted in the ToS.

    The Gateway was mobile.

Gateway was browser API, small/mini game and also feature which allowed for players access their inventory, bank, Auction house and crafting and even invoking..
It was very popular for those who loved to run bots... And I can assure you, there was a lot of players exploited gateway to full extent..
Also time to time was happening account hijackings.
That's why it was decided to get rid it, and also if I remember correctly, we migrated from previous forum, which was powered by vBuletin engine, to current ( vannila)..

Geteway was not a mobile device software (which is what the ToS's Mobile Software section refers to).

The so called 'Neverwinter' app (for smart phone) that interfaced with Gateway in the old days was written by an individual player with no relationship with the company.
Yes, I used that but it was a pretty sucky app. Now, I think about it. It could have the potential to be a bad software to steal my account (no, my account was not stolen).
