Kinect Microphone - Potential Privacy and Annoyance Issue

Hi Guys,
I'm wishing to report what may be a privacy issue.
Some of us have noticed that in a recent update, voice chat seems to have been activated for any team-based missions (PvE). I'm not aware of any notification surrounding this development.
Thus, for those who use Xbox Kinect and have neglected to switch off the option in settings for the Kinect Mic to be used for Chat - we're getting a lot of PvE matches where we can hear people talking - seemingly oblivious to the fact that we can hear them.
It is also an annoyance given that it means we're getting a lot of feedback from the speakers of some users back through our own system.
Most importantly perhaps is the privacy issue. People are having conversations in their home without being aware that we can hear them. I try to message people where I can, which isn't easy while playing a PvE at the same time.
At first I thought it was perhaps just my machine or network settings, but conferring with a few other players, they have admitted to hearing the odd voice or coughing that didn't seem part of the gameplay.
I thought I'd give it a few days to see if the situation was fixed, but as of last night, I had to mute my machine as I was getting too much feedback from what must have been someones broken kinect - which impacted the experience of gameplay.
