Those weapons only activate their blade when they are drawn, if you only carry them around holstered you just end up with weird looking sticks on your back.

What seriousdave said. Also, if you DID try to swing it around and didn't see any visual effects, well... I can't have any certitude about the red bat'leth, but the blue one does work fine for me.
Upgrade it? Honestly, the biggest amount of time I spend using melee weapons is with the Borg, and that blade is the only one that they adapt to. It's a fun thing, but...

They adapt to it because its method of attack is a focused energy beam into a shape, but still is energy based which Borg can adapt to. Worse yet... the energy type is plasma... the very energy type the Borg uses, which means they probably can adapt faster to it.
While I understand why they adapt, and I see the logic to them adapting faster to a familiar energy type, did Cryptic really bother programming in that difference? I don't think so...

The Borg are irrelevant when you're fighting Voth, Vaadwaur, Undine, Terrans, Heralds.... well you see where this is going.
um... yeah... several times actually... the nanos from the first three years that ahd nanos can be upgraded, but not the ones from this year or last year.
It can activate in non-combat areas with the shove motion, just not the primary & seconary swing.
I'm not sure the shove works in the Winter Wonderland. I suspect that's the problem. People buy it at the winter vendor, try to use it without changing maps, and immediately assume ERMAGEHRD BROKEN.
Speaking of Bat'Leths, the Shard Sword of Khaless could use a stats boost for supposedly an Epic weapon. Fleet Bath'let's sort of put it to shame. We also need an Episode to go get the one used by Khaless in House of Pegh back.
