Seems to have a 3rd Character Slot, AS A FREE TO PLAY USER.
He has a FED/KDF Character Already and the Buttons to make a new character are clickable, when mouse over it says "you have 1 unrestricted character slot available"
i know for a fact he hasnt purchased any,
So where did this third slot come from?
I dont have a 3rd Slot and I registered before him, I also have a "Purchase Additional Slots" button underneath the greyed out "create new character" buttons.

If you are gold, you get 3 slots total. There was another guy about a month ago who downgraded to silver and even though he didnt create a third character while he was gold, the slot remained after the downgrade.
Another way to confirm would be to check to see if your brother has more inventory and bank slots than you do. If he does, then he was definitely gold at one time or another.

I can confirm that you retain some perks after downgrading from Gold. I've still got a 3rd character slot, and several Gold-level perks on the toons I had at the time that I haven't deleted. I created a new one recently and it doesn't have the perks because I created it while freeplaying.

I did that as well, I specifically just subbed gold for 1 month for the respec tokens, extra inventory slots, extra bank slots and third character slot. Difference is I created the third toon while still gold and parked him because I thought the slot would disappear when I downgraded.
After I downgraded, used my single stipend to unlock the EC limit. Good value for $15.
If he bought a copy of the game, even a $5.00 copy off of ebay or put in a code from some free offer, he would be considered gold for a month even though he's silver. That would explain the extra character slot.

If he was gold at any time, he would have had 72 inventory slots. Unless...he was gold, but never created those characters until after he downgraded. I know I am really stretching it here, but just spitting out possibilities.

It's a common sign of your account having been TRIBBLE if you've never spent any money and suddenly it's got restrictions lifted. Often the account holder is reluctant to report the hack, because they don't want to lose the "gift" they've received, too.
However, yes, my post was meant to be sarcastic; to get the poster to look closer into the account history. 99% of the time when somebody says an account has a capability that can only be acquired through something they say didn't happen, it turns out it actually happened.
That being said, if you are TRIBBLE, as a well-paid security professional I stand by the steps I listed:
1) Wipe the PC.
2) Reinstall the OS, then a good anti-virus and firewall, then all available vendor patches.
3) Change your email password.
4) Change your game passwords.
5) Only then reinstall your games.
I've never been among the "try letting your anti-virus/anti-malware remove stuff first" crowd. We don't do it at (giant company I work for who'd prefer I didn't mention their name, but better than 99% of you would recognize it if I said it), we didn't do it at (big company I worked at before), and you shouldn't either.
In the old days devs would sometimes research these things and then post an analysis saying "your friend actually bought Foo 11 months ago, and probably forgot". I miss those days; Rehpic used to post some great ones.
I can't link it, but an ArenaNet dev recently outed people on Reddit for claiming their bans were for "no reason", listing the often-hilarious reasons, completely uncensored. I LOLed hard.

They wouldn't go into the WoW store and spend hard currency to load up somebody's toon with premium mounts and vanity pets, lol.

As a computer technician and remote support employee for software, I cringe at your advice and recommend you not recommend people to do x y z, unless you know x y z is actually the cause of the problem.
Wiping a computer's hard drive clean, is the LAST option ( and I do mean last, because there is usually always a solution ) you take when dealing with spyware/trojans/malware/etc. Also, not everyone will be experienced enough to know how to reinstall an operating system properly or even wipe a hard drive this is again not something you should be recommending as a viable solution to any regular user problem.
In all honesty, this doesn't appear to be your area of expertise, it was bad advice.
As for your gold farming post, again you have no proof to make such a suggestion, and you didn't ask any appropriate questions to gather that evidence to even determine a proper course of action for said player. Keep in mind, the initial poster is talking about someone else's account, so you are actually helping no one directly anyway except possibly causing problems with other peoples computers.

the only differences are:
-I've logged into my account on his PC (authorizing my account on his PC as well as mine).
-He Plays Community Authored content sometimes (I havent touched them)
He doesnt have any Zen (well he does now), but He has nothing on his account purchase history, so it was unlocked some other way.
So, somehow, his account has acquired Zen, and unlocked a capability you can only acquire via Zen?
Wipe his PC. Reinstall the OS. Install a good anti-virus. Then have him change his passwords; first on his email, then on STO.
