Even though its almost entirely cometic, so far, Discovery is in STO. Several ships are included, and a blog post identified the Battle of the Binary Stars.
But the current Foundry EULA doesn't include Discovery as part of what we're allowed to draw from to make Foundry Missions. The could be purposeful (just because Cryptic has the right to use something doesn't;t mean they're required to give it to us), but it could be accidental. Cryptic has a lot of things to do. They might've not thought about updating the EULA.
So, do we have the right to include Discovery elements in Foundry missions, or do we not?

A certain lead producer/Foundry Matron Saint has given us the Discovery uniforms to play with and our community manager expressed positive interest in our attempts to build a discovery interior in the Foundry. There's no sign (top to bottom) of there being reservations at Cryptic in us exploring Discovery species, themes, and content (not based on any actor likenesses). Furthermore, STO is also a CBS licensed game. Prior to their inclusion in STO, Kelvin Timeline content was off limits because that belonged to Paramount (and EULA concerns definitely applied). Here the potential complainant is CBS and we're effectively starting off our related Foundry plotlines with Discovery content already in the game.
So, I say go nuts (within the normal boundaries of good story telling and other EULA concerns) unless we start hearing otherwise.
