Of course I'm serious. If a player purchased the product, used them, then had the gains from said product removed by the seller of the product, but no refund of the product to the buyer(not to mention the insult of being labelled a cheater) - thats clearly unethical and in many places illegal.

I wish you the best, perhaps you may have a solid case. I do not know the laws pertaining to virtual goods, but I assume there is something out there in the law books. Just don't even try to go anywhere near the gambling issue, that is a dead horse well beaten.

well go read them cryptic was well within their legal rights to make any changes to the game without notification or reimbursment.

Anyone who purchased and used XP boosters, while then utilising an exploit are gonna be **** outta luck if they think they'd have a leg to stand on, if this nonsense hypothetically made it to court...
They'd need to be able to demonstrate, without question, that they did not participate in activity that contravened STO's terms of use etc, and that their actions did not knowingly, or otherwise, take advantage of unintended mechanics in order to gain an unintended benefit (exploitation)...
Cryptic on the other hand would walk in with their data and be able to demonstrate in black and white what happened, and why the use of those XP boosters became null and void in a class action, requiring individual people to then seek reimbursement independently, coming back to suing over just a few dollars...
If you feel Cryptic ripped you off, stop spending money if you don't stop playing entirely - good luck doing anything else...

TOS and ULA are not 100% ironclad... local laws may trump them.
But you'd need to prove you bought them... used them. Document the loss of xp.
Hire a entertainment laywer(s). Some may do it if they feel they can win or will get them press... but at best your looking at a refund of your zen or having your boost replaced... at worse account closed
But if your serious... small claims court is where you want to go to... the product you bought fits that and you'd probably get more headway than some big class action.
There are several grounds on which to challenge various notions covered in an EULA or a TOS. They aren't indisputable documents, and they don't necessarily hold up, as you'd think they would, under scrutiny.

Go ahead, file a lawsuit. You'll be slapped with a 12(b)(6) motion so fast you won't know what hit you. If you're lucky, they won't countersue you for exploiting and violating your end of the TOS.
You are sorely mistaken if you think you own anything related to this game(much less have it "taken" away). Everything is theirs and you accepted the agreement that they can do whatever they wish with it.

Well, truthfully, I have no idea about the stauts of TOS in the united states, but in Europe, specifically in Germany, courts of justice repeatedly dismissed EULAS and TOS's, in some cases even declaring them rightout unlawful to begin with. So depending on where he lives, probably even in the united states, there is a realistic chance of success.
Actually I bet they would pay out. If you sued and handled the legal filling yourself (to save on $400 an hour lawyer fees) PW would likely payout a settlement instead of their legal team to litigate. Pay a pissed off player a couple hundred bucks or ten's of thousands in legal fees.
Well, I don't know much about the legal issues but I know pretty much the TOS lets them do as they please. I've bought many things in the past and were subsequently nerfed just like the XP boost.
I think the difference here is they are still letting you keep the first 55k+/- XP you gained as a result of the exploit in the game or the first 10 spec points. They also aren't taking away points from those who didn't use the exploit at all. That's more than enough to compensate for 3k xp boost or even a 20k xp boost.
The game has punished users of exploits in the past by banning your account so I would be happy with this compromise.

A TOS is not some ironclad agreement. They have been challenged and ruled unenforceable in court in other cases.
