Question About Unique Items

Why aren't my items that are supposed to be Unique, aren't? For example, my KDF has a Shard Sword of Kahless, which is supposed to be a Unique one. Why aren't Very Rare items turning Unique? Can I grab another Sword of Kahless in the Unique quality?
