Sure... if they're meant for actual use in-game. Making testing placeholders that never get used in live assets is nothing new to game development. I loved looking at test junk in another MMO's game files

So we have been told in that past that the reason X ships cannot be added is because CBS has not approved them. We have also been told that CBS has to approve all of the ships that go into the game. However we have already been told this was not supposed to be in the Foundry, so that point is moot now.
Here's what we know; According to Al Rivera, Cryptics' license from CBS allows them to use anything from TOS, TNG, DS9, VOY, ENT, TOS movies, TNG movies. TAS is done on a case-by-case basis. Basically anything CBS holds full rights to.
So that means JJ-Trek is a no-no, and any IP from licensed works such as books requires an agreement between the author/designer/publisher, and CBS. This is why the Vesta class is taking a while to get traction.
Now just because Cryptic has the rights to use X doesn't mean CBS will allow them to. It's likely the approval Cryptic speak of is in regards to how they plan to use X.
Based on what we have been told thus far, it's likely the level at which something requires approval is down to how much visibility it has, how much player interaction is has, and the ability/potential for Cryptic to profit from it.
Lets pick the Akira class as an example. Cryptic has the rights to use its name and likeness, but they would have needed approval from CBS to use it as an NPC ship, make it playable ship, make it an escort, and its original tier and specification. Likewise, the designs and specifications of the Thunderchild and Armitage refits would have also required an OK from CBS.
It all comes down to the Derivative Works section of IP and Copyright law. Which allows IP rights holders to control how their IP is used and to be compensated when third parties use said IP for commercial purposes.
With that in mind here are some of things we know CBS has said No to;
T5 Connie = We've been told multiple times that CBS doesn't want players using it in game at that high a level, they're even uncomfortable with it being in game as a playable ship because of its age. They likely have similar misgivings about the NX, Miranda, Oberth and Excelsior, only including them for their nostalgic popularity.
Players flying non Faction Ships en Masse = CBS have said they do not want lots of players flying around in ships that aren't native to their faction. This is why the Jem'hadar Attack Ship, Cardassian Galor, and Ferengi D'Kora are in lock boxes. Whether the number of them released into the game is to CBSs liking is unknown.
There are likely other thingson which CBS is still undecided, one example;
Wells class Timeship = In Al Riveras' latest interview with Priority One he mentioned hed been trying to get the Wells class Timeship (from VOY; Relativity) into the game but was experiencing hesitation/resistance from CBS. It's likely if it ever does make it into the game it will be an NPC ship, or if playable, in extremely limited quantities.
The fate of Data and the Enterprise E[/B] = Other than what's been established in "The Path to 2409" and "The Needs of the Many" CBS has not allowed Cryptic to say where they are or what has happened to them, only that both are missing.
Just a quick note on this. Cryptic Kestrel aka Christine Thompson has been allowed to write about the destruction of the Ent-E. Even if it was in such an obtuse way. Her story was featured in Star Trek Magazine.
What a Dev does in their spare time is none of our business, so thats cool. That said, actually putting it in the game is basically making fun of the people who asked for a T5 connie. So if you guys want to make fun of players in such an official way...ok. Did CBS actually approve this being put in game?

It would be interesting to read, but I've found getting hold of individual issues of magazines, especially ones not published in my country to be difficult and costly.
Though it seems odd that such a major loose end for STO and Trek was released in a magazine and not as a standalone work.
