(i looked up the TOS, and right there, bold as brass, is the answer: NO interfering with others game. that would cover KSing, PKing, boss pulling, and any other harassment. I think this make things pretty clear.)
You must observe these Terms, all Rules of Conduct, all applicable laws and all basic rules of etiquette and common courtesy when using the Website and the Service. Any conduct that violates the law in an offline, real world community is also a violation of these terms. PWE will not tolerate any illegal or offensive conduct.
Without limiting the foregoing, in addition to the User Content rules set forth in Section 10 above, you agree not to take any of the following actions:
(a) Harm minors in any way;
(b) Impersonate any person or entity, including any PWE officials, forum leaders, guides, hosts, employees or agents, or falsely state or otherwise misrepresent your affiliation with a person or entity;
(c) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any message transmitted through the Website;
(d) Upload, post, e-mail, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation;
(e) Interfere with or disrupt the Service, the Website or servers or networks connected to the Website, or disobey any requirements, procedures, policies or regulations of networks connected to the Website;
(f) "Stalk," threaten or otherwise harass or cause discomfort to another;
(g) Collect, store, post or otherwise disseminate any personal data about other users;
(h) Impede or disrupt the Service or the normal flow of game play or dialogue in the game or in Interactive Areas on the Site or use vulgar language, abusiveness, use of excessive shouting (ALL CAPS) "spamming" or any other disruptive or detrimental methods in an attempt to disturb other users or PWE employees;
(I) Engage in, encourage, or promote any illegal activity, or any activity that violates these Terms or the Rules of Conduct;
(j) Engage in any actions that defraud or attempt to defraud, scam or cheat others out of any items that have been earned through authorized game play;
(k) Cheat or utilize unauthorized exploits in connection with the Games or the Service;
(l) Using or exploiting any bugs, errors, or design flaws to obtain unauthorized access to the Service or to gain an unfair advantage over other players,
(m) trade, sell, auction or otherwise transfer any virtual items or goods of any nature outside the game; and/or
(n) Take any action that disrupts the Service or that negatively affects or may prohibit other users from enjoying the Website, the Games or any other aspect of the Service.
PWE may take any actions and impose any penalties we deem necessary to discourage and punish any violation of these terms or any other illegal or inappropriate conduct, all without prior notice or warning. The determination as to whether a violation has occurred and who is responsible for such act is solely within PWE's discretion, and is based on what we deem best for the community and the Website. If you play on the PVP server and get killed every 3.25 seconds... so what u chose to play there.
If you play on PVE server and turn pk mode on, ALL BETS ARE OFF. Even if the same person kills you ever second you step out of the SZ it was YOUR choice to go white.
Sure there are things like being a good sport or not doing to others things you dont want done to you, but there is no rule in stone that sais u have to follow those guidelines.0 -
I would agree KSing is against the TOS, anyone else agree? it kind of hasn't been addressed much, and personally I am really tired of being KS'd all the time >.>;
but PKing... it just makes me facepalm when I see people complain about being PK'd, there is a duel function to the game, if you only want to fight other players when you feel like it, then why play on a PK server? use some common sense people....
According to the TOS and using the same language, I think we can say that PKing is part of the normal game flow (for PK servers) and having someone come up to you randomly and kill you is part of that flow and expected on a PK server. Furthermore, PKing someone does not prevent them from enjoying the site because you are free to enjoy the non-PK servers =3 if you can't enjoy the game because of PKers, it's your own fault for choosing to play there. If you want to fight with mutual consent, use the duel function.[SIGPIC][/SIGPIC]

Being PKed over and over and over by the same person in a matter of minutes is griefing I think. Random PKs every now and then which the OP wants bans for is not griefing and therefore not bannable.0

PK falls under the built in discretion that PWE allows. You fail with Contract Law.
Besides, if they offered a PvP server so blatantly against the explicit contract that we agreed to, they would be violating US Contract Law and any Cash Shoppers would be refunded their money.
I do agree though, there are limits to PK. Keyword - Limits. Kill on Sight and PK'ing red names (or even going red) is not against those limits. Continual griefing around a spawn area to the point that playing the game is impossible or unlikely violates the ToS becasue that goes against(shock) :
(h) Impede or disrupt the Service or the normal flow of game play
(n) Take any action that disrupts the Service or that negatively affects or may prohibit other users from enjoying [. . .]the Game.
Learn to tell the difference between various levels of gameplay please.

I am, and I'm sure others are, negatively affected by your actions to ban PK, equate real life violence to in-game violence, the creation of a robbery and **** server, and general overall lack of intellect regarding your arguments to prove the above. Thus, by the ToS and your own actions, you should be warned at least, banned at most. The amount of replies to your asinine arguments bears testament to your actions.0 -
In PvP server pk is actually a way to SLOW levelling. So a strong guild might want to pk a lot just to avoid players to lvl up. Thats why you join a guild, to have a some advantages. Im veno, I get pk ALWAYS, its my choice to go to the same place again, even if I have a quest I can go anywhere.
If you get robbed at same place, will you willingly go there again knowing you can be robbed again? I dont think so...
Pk...pvp its a function of the PvP servers, thats why exists alliance, neutral factions and even KoS. Somes only PkRed... its how the game works, and Im talking here from the side of those who GET pkED and dont pked much....0 -
I for one find nothing in pwi more thrilling then looking in guild chat and seeing a guild mate call in for help killing a pker. I usually don't respond to these considering 80% of the time its a lvl 30 crying he got killed by a lvl 80. But the rare moments when you get a small group of you and you all meet up and square off against another small group from an opposite faction. The tension builds up, everyone is buffed, you have the two melee's standing right infront of each other, waiting for the other to attack first, the Veno's summoning pets, the Clerics hovering in the air, Archers ready to let loose, and me the Wizard standing far far back hoping not to die to fast, and maybe get off a tempest before I die b:surrender. lol Nothing more thrilling then a good old pk fight.b:victory[SIGPIC][/SIGPIC]

The problem is that everyone here has a different definition of what "harassment" is, including the GMs.
In the end, the way the ToS is phrased in makes it more or less useless to deduct a code of player behavior from, since the words in it could mean nothing or everything, depending on how you read them. In the end, the law is being made by the GM's interpretation of the words. They are also the ones with the ban-sticks, which makes their interpretation the only meaningful one. I have never seen GMs taking objection to PK, so I'd say it's fairly safe to assume they consider it legit. It's kinda bad that we more or less are required to read every GM post on this forum to be able to adhere to their rules since proper player behavior _should_ be clearly written in the ToS and not spread over 10,000 postings on some forum - but the problem is that the ToS was likely written by a lawyer and I have yet to see anything useful ever produced by a lawyer.[SIGPIC][/SIGPIC]0 -

I think the ToS was left vague enough so GM can have some leeway in applying it.
It's like policement in real life. It's forbidden by the law to drive a car at 71 kmh in a zone limited to 70 kmh, but you are unlikely to be arrested for doing so, even if they can arrest you. And if they do, there is little you could do about it.[SIGPIC][/SIGPIC]

The first and second parts to the above is pretty much what I was trying to teach FoxRunning, but now that the answer key has been posted, oh well.
You probably explained it in a much better way than I did though.
As for the third part, I do agree there. Actually, the ToS is fairly boilerplate, meaning it conforms to standard liabilities they might encounter. The nuances, which I've highlighted in red and yellow in my post, are the problem. Thus it's pretty much "don't make waves for us" type enforcement.0 -
I play on a PvE server and have never gone PK to this point (though I'm sure I will at some point), and I'd just like to say that FoxRunning is clearly infringing on my own personal TOS interpretation on the game. Can someone ban her please, or if not then is there a way to just blacklist someone on the forum so you never ever EVER have to read their posts again?
Cause and effect is a really simple concept that even a 12 year old child could understand (not saying Foxrunning is 12 btw):
You choose a PK server, you will get PK'd at some point.
You chose to go white name on a PvE server, you will get PK'd at some point.
TOS in this case are so far open to interpretation by anyone that reads them that they become irrelevant, and the fact that you have spent so much time finding ways to try and realise your own little fantasy world whether the rest of us want it or not seem to indicate that you have far too much time on your hands and a limited grasp of the reality that there are a significant number of people that ENJOY playing the game in a way that you do not approve of.
Personally I think anyone that drives a car with an engine size of 1ltr or smaller, or anyone that drives at 20mph below the speed limit in perfect road conditions deserves to be shot. I doubt that will happen and I'm not deluded enough to ever dream that it would. Mr Reality check needs to pay a visit....0 -
A suggestion to PWI to fix all these problems.
Add into your rule book.
Kill stealing is ok.
Player Killing is even better when possible.

I find that so many people want so much so easily. I am so glad that I have rolled a PVP character now. There is definitly less issues here. I do miss my friends I had on PVE but when ever you have an issue with a KSler then just PK them.

No seriously I totally agree with the OP. Why just the other day I was having a tea party with the butterflies over the lake of woe, and then someone stated killing them, for I quote "experience points"
They killed my friends the butterflies and completely disrupted my gameplay experience. Since my being unhappy goes against the TOS, I demand these players killing the butterflies be banned.

Seriously OP, do you even read what you post? If one person is disrupted, another is happy. That's usually how things work in games. It's about balancing it. Play a game without PvP if it makes you that sad, they love whining in those games a lot more than we do.

Rules only apply when it does not infringe on the rights of others. Players have the right to play the game without being randomly killed by other players. Just like people have the right to live without randomly being killed by another person.

You need serious psychological evaluation if you can't separate this game from real life. I'm from LC and I PK people everyday, does that mean, even with a lack of consequence and rules forbidding killing someone IRL that I would do it? Of course not.
Anyone who actually thinks this way should be put into an insane asylum for treatment because THEY are the ones who pose a risk to society, not the ones who can separate IRL from a GAMEEEEEEEEEE and enjoy all aspects of it.

(m) trade, sell, auction or otherwise transfer any virtual items or goods of any nature outside the game; and/or
(n) Take any action that disrupts the Service or that negatively affects or may prohibit other users from enjoying the Website, the Games or any other aspect of the Service.
PWE may take any actions and impose any penalties we deem necessary to discourage and punish any violation of these terms or any other illegal or inappropriate conduct, all without prior notice or warning. Rules only apply when it does not infringe on the rights of others. Players have the right to play the game without being randomly killed by other players. Just like people have the right to live without randomly being killed by another person.
When you infringe on the rights of others, thats when it becomes a problem.
I can just see it: A person gets charged with murder and gets a few years in jail. As they pull him out of the courtroom he's shouting "Life is PK enabled so its not against the rules to PK!!!!!"

1. Real life - Once you kill someone they're gone for good, no respawn times, no magical powers. Other people that knew that person will be affected as well. Why you ask? Because they are gone forever. Never to show emotion and never to see or hear from them again.
2. Fantasy Life -Kill someone they can come back and try to PK you too, they aren't gone for good, they will still be there. The people that are playing these characters are still alive and well are they not? I don't see a lot of PvPers making death threats on that person's life. (Their real life.)
Do you understand? Please tell me you do. Pretty Please? People take comfort in PvPing because it's all in good fun, you won't be taking someone's life, you won't make that person's family suffer if you PK that person, and if that person takes PKing far too seriously that they begin to cry about it, then that means it's not their type of game.
PvP is for people who love competition. PvE is for people who like to play at their own pace.
In real life, people don't have a health bar over their head that goes down every time they end up getting hurt. The only reason why the PvP servers are filled with drama is because there are a ton of people who for some reason decided to choose a PvP server and never expects to get PK'd or to suffer any of the other consequences that come with a PK server. There are also those people that when PK'd, has to go around shouting insults and coming up with excuses so they can try and save face. This has become such a common attitude in PvP games now a days, that it's not only sad anymore but now it's just too hilarious.
Originally people PvP'd because they love competition, but now seeing your victim whine and insult you because you PK'd them is so common now a days, that it's just an added bonus, because it simply makes them look like an idiot.0 -
