selling acct is bannable ?? i didn't really read tha TOS any1 know cause i have a screen shot of some1 wanting to sell acct with herc ...they shouted in archo

Yes it is.
PWE gives you authorization to use the account you create, however, they retain ownership of the account itself and all the content, even the stuff you buy with gold.
Since the account is not yours (it belongs to PWE), you are not allowed to sell it.

The short answer:
You do not own your account, PWE does (PWE just gives you permission to use the account), therefore you are not allowed to trade it.
Think of it as renting. You are renting the account (free of charge), therefore you cannot sell it or trade it without PWE's permission. And they do not give you permission to do either.
The long answer:
TOS section 4
PWE is the owner of the Website, the Games, the Software and the Service, which are protected by US and international law including copyright laws. All rights and title in and to the Website, the Game, the Software and the Service, all features and content thereof (including without limitation any user accounts, titles, computer code, files, game software, client and server software, tools, patches, updates, themes, objects, characters, character names, stories, storylines, objects, content, text, dialogue, catch phrases, themes, locations, concepts, artwork, designs, graphics, pictures, video, animation, sounds, music, musical, compositions, sound recordings, audio-visual effects, information, data, documentation, , "applets", chat transcripts, character profile information, game play, and recordings ) and the selection and arrangement thereof (collectively the "Proprietary Materials") are the proprietary property of PWE or its licensors and are protected by U.S. and international copyright and other proprietary rights laws. It has to do with intellectual property and virtual goods. The terms are written in this way because, although you do purchase the items, it does not denote ownership. I mean "ownership" in the sense that when you completely own something you can do as you like with it. In our game we retain ownership in order to prevent unauthorized sale of our virtual goods for real money or other things. Also, if a player violates our rules they acknowledge that they can retain no rights over items that they have purchased. If they did that would mean that we would be unable to take action against them without allowing them to keep their items.
Trust me it's nothing shady, every MMO has the same thing written in their terms

Kind of like how you can go out and buy a DVD boxed set of a TV show you watch. You own the dvds, and can watch them as you want to. But you can't make lots of copies and sell those on ebay, and you definitely can't take your copy of Lost, walk up to a TV station and say "Look, I own this series. I want you to broadcast it and send me the advertising royalties."
