Ok as soon as I lvled to 32 I went and got my self a torgin brave and reverted my magmite back to the egg. So i see that the togin takes more damage then magmite.
so is it worth relvling a new magmite or stick with the torgin ?

Er, did you dump the egg? You can always just rehatch it. If you've already dumped it then yes, it's worth getting another magmite.[SIGPIC][/SIGPIC]0

The Crystalline Magmites and Volcanic Magmites will both be better for stats than the Torgirn. And the Torgirn's skill levels don't justify the switch really. I'd suggest the Crystalline overall b/c they do have slightly better stats for tanking than the Torgirn. However... The Torgirn also better starting skills than the Crystalline if you're feeling cheap. They come with Bash lvl 2, Sandblow lvl 1, and Tough lvl 1 vs. the Crystalline's Bash lvl 1 and Sandblow lvl 1. You're most likely going to want the Bash and Tough on your final skillset so that's saving you 500k in skills / upgrades in the end.
Personally... For my dream Magmite... I want Tough lvl 5, Strong lvl 5, Blessing lvl 5 and either Bloodthirst lvl 1, Roar lvl 5, or Bash lvl 5. The odds of getting 3 of those skills are very low since they're "Temple of the Dragon" only.

Just wanted to point out that the skills you listed for the magmites are incorrect.
Here are the starting skills.
Volcanic Magmite - Bash lvl 1, Tough lvl 1, Sandblow lvl 1
Crystaline Magmite - Bash lvl 2, Sandblow lvl 1
which will result in the Volcanic being 100k cheaper if you go for the same skill sets on each.
I havent tamed the torgirn so I dunno about the skills. I do agree that the volcanic and crystaline magmite will have better stats than the torgirn at the same lvl.
if you still have the egg, just rehatch it. Note though that all of its loyalty will be gone. It disappeares when you turn it into an egg. Either way, lvling a crystaline or volcanic again will benefit you more than a torgirn.
As for my dream Crystaline.
currently :
Bash lvl 3
Sandblow lvl 1
Roar lvl 1
Tough lvl 1
Want:
Bash lvl 5
Roar lvl 1
Tough lvl 5
and either hp boost, phys def boost, mag def boost, or attack boost.0 -

Why would you want Protect on a Magmite? O.oa I'd only use Protect on a Frogling or Antelope Pup. I can see the benefit of Claw, but if I ever got that skill I'd throw it on my Scorp before I put it on my Magmite.
I'd go Blessing, Strong, or possibly even Threaten if you're using those other three skills. Threaten's nice b/c it lowers the phys atk power of a mob in the same way that Tough increases phys defense. But... Blessing and Strong obviously win out because they give such massive increases and last for an hour.0 -

I honestly haven't looked into what they do yet. I was just going by what I feel are some of the golems weak points. he is the only pet i'm gonna put money into atm and the only one I am leveling. Maybe get a A Dharma later on.
I want him to have more survivability and I also want him to keep aggro better so a higher phys attack skill would mean I would have less chance of takin aggro and i could pump mag more. It's just some options I would be considering.
although the one you mentioned that reduces phys attk is one to consider also.
again, haven't really looked into the skills much as i don't have the money for another atm.
