Why are ppl allowed to create a character with the same name as you if you have been playing for way more time than the new guy is. Nick name or character name should be unique on the server !!

Because they use name@name format. This allows for duplicate char names so they don't have to "fix" this when they merge shards (whenever that will happen).
    Foundry - Fight Club? (nw-dluqbofu7)
    - JailBreak (in development)

The way Cryptic games work (CO, STO and NW) is that the names are bound by @handle. That's the only part that's unique.

    Because people are not special.
Are you sure you were the original one? Yup. Be glad that you can use names you want to.
Cryptic games use @globalnames as identification.
And if you name your character as Drizzt Do'urden, expect to run dozen same named characters. (This was an example.)
And good thing is you don't need to use XxYOURNAME3464675xX. Just seems people haven't realized that yet.
