Possible bug with the mayor speech open mission

I read on another thread that a boss in one Lair was found to have been too hard because it had both Tough and Legendary applied to it. I was wondering then if Viper X, the boss at the end of the mayor speech Open Mission in Millenium City, is also bugged as yesterday he was a level 20 Legendary (Tough). Maybe that's by design, but since this was already flagged as an issue elsewhere I figured this might be bugged here as well.

We tried attacking him but he would just one or two-shot most of the heroes and nobody could down his HPs faster than they replenished.
