Which part of the "items" being the packs eluded you? Why did you assume the contents of the pack was what the "Available Now" meant? Pre-Orders for many games have had "Available Now" in their advertisements, what made this one different?
I should point out that the Moon Elf in the pack is labelled a "Unique" Moon Elf race. Since they said we're getting everything they advertised in the module for free, it's highly possible there's a "Paid" Moon Elf and a "Free" Moon Elf. Much like there's already a "Paid" Drow.

No, it does not take EXP from you. When you die you suffer an Injury, which reduces your max HP and your stamina gain. This stacks and eventually becomes a severe injury, reducing stats. Minory injuries are mended by standing by a fire for 3 minutes or using an Injury Kit.
