I would like to suggest that the mechanics of hunter mark would be changed. The reasons are these:
a)You don't shoot a target, scaring him and naming it you prey afterwards – you chose your target and then you shoot an arrow.
b)The necessity of ranged encounter powers to apply mark is limiting the choice of encounter spells on hunter ranger thus reducing the dynamic of game play.
c)In d&d 4 rangers have quarry similar to the mark of defenders that use separate action to be applied, therefore separating it from powers would bring it closer to the D&D lore/mechanics
d) Archery hunter doesn't use the signature hunter power – stance switch enough in comparison to other trees.
How this mechanics could be changed – i would suggest using the similar mechanics to guardian fighter for mark application. If you target a monster or an enemy character and switch your stances you mark him as your prey. If none is targeted – the switch would not apply the mark and would only switch stances.
The impact of this to the game would be minimal as 20 second timer on mark would limit the usage, and would only increase it in cases where there is a shortage of encounter attack powers. (Taking into account that encounter powers don't have cd longer than 20 seconds among single target attacks for hunter tree)
So practically this would give a bit of utility in choosing targets, and would give a bonus to damage on the first shoot, without warning your opponent so obviously. As hitting him with encounter attack.(could be implemented as non provoking mark for PvE)
