    This should clear up the matter. From Foundry EULA:
    You may not make use of any copyrighted or trademarked material of third parties, without irrevocable licenses granted specifically for that purpose.

    What if the material we wanted to use is no longer in print but not necessarily public access yet? I was wondering about making a foundry quest based on an old MERP gaming module. ICE lost their rights to publish MERP back in '99. If I changed all the names and places and gave credit to MERP for the story line, would it be permissible since the module in question is no longer in print?

    Out of print and public domain are two very different concepts.
    Even though it's out-of-print, and ICE can't reprint it, someone still owns the copyright on it. In addition, it sounds like not only are there copyright issues involved, there are licensing issues.

    All of this said, I'd be very surprised if there were any problems from your making a Foundry quest based on whatever it is. I see foundry quests quite often that are based on copyrighted material that I am sure the writer does not have permission to use, and nothing happens. Heck, I've seen foundry quests that are as direct a copy as possible of quests from that other D&D MMO.

    At worst, I think you would simply be ineligible to have your quest considered for Featured. But that's just my guess.
