Got "Error 36: A file was locked that could not be open for writing.", too, while patching and found another solution that does not require disabling your av and running the game with administrator privileges on Win7:
- right-click the directory your game is located and remove write-protection
- on security tab click "edit" and add the account you are using to play the game
- give that account full access and set these permissions recursively for all sub directories
- start game - enjoy

FYI this was an instant fix for windows 8 allowed full control and patch went through and i am now happily playing again.
