Divine Challenger for Smite not working

I've noticed that Smite does not seem to place me on top of the treat list even when using the feat Divine Challenger. This is especially noticeable after dying and trying to regain threat on a boss. I can use Smite multiple times and it still doesn't grab agro back. Anyone else having this problem?
