Death penalty live or bugged!

Either right now, the Death Penalty is active or its bugged. I just did a episode and was having trouble when I noticed my crew had a huge greyed out area, this is strange because I haven't died in quite along time too! Whats worse, trying to kill a /// Nausician Battleship in a (6) patrol mission with death penalty = NOT FUN!!!
