I do believe animated gifs are a no-no.

I agree with the previous poster. I think it is the .gif that has to go. You are not the only one who used .gif avatars, but you are the only one left I have personally seen recently.

If you want to get technical, the rule says:
    16. Signatures are limited to five lines of text, including blank lines, or an image that must be no larger than 500x150 pixels and 50Kb in size. Images must be in .jpg or .gif format. No animated .gif’s will be allowed. The text in the signature may be customized by the BBCode in use on the forums. It is recommended that you stick with readable fonts and colors and that the size is not too large. You may mention websites and ventures that you are in some way related to, as long as they are otherwise appropriate for this community. Focus on things that you like, not things that you don't.

My emphasis added. Whoever is in charge has decided to enforce a preexisting rule. Their forum; their rules.

I know this rule applies to signatures, but I would imagine the same is true for avatars.

To get even more technical... this thread could get you an infraction. While you may or may not have already gotten an infraction.. talking in a thread about what was said to you in private by a Cryptic moderator is against the rules. They will never openly discuss your business in public and they kindly ask that you to do the same.

    As stated here: http://forums.startrekonline.com/announcement.php?f=20&a=3

    Darren's is a gif isn't it?

It was, and frankly, why can't everyone do it?

There are rules, and they were not enforced till others complained they couldn't do the same. That's fair though.

To OP I would suggest changing yours to just a pic, the dervish thing was old, years ago, and really like your avatar suggests, I wonder why it shows up in games far older than this one....

Special people aren't as special as they think they are. (not to mention not even original).

Signature. That is an avatar. No?

Also unless he received a "disciplinary action" i believe he is free to talk about it.

    Everything has been covered before.

As to the quoted part, yeah maybe you are right, if you haven't been caught doing something it's ok to do.

Thanks to your suggestion I'll report him now......

also id like to see that email

There is no email only a click on the little triangle.

I really don't care you have one, I'd like one. When you start to think you are special and should be allowed to have it when I can't, or OTHERS can't, that becomes a problem. Sure you could say I'm jealous, but I could also say you are being selfish because others have had to lose theirs.

That doesn't even address the fact that WTF Dervish, is old to a point of almost being cliche (MMORPG wise).

This rule, is the one that matters the most.

    19. Cryptic Studios has the final say on all aspects of these Forums. If you have a problem, you may make a complaint to Cryptic Studios directly and not publicly on the website. Creating threads or posts that question or reference administrative decisions or potential administrative decisions, such as post removals and thread closures, is not permitted. If you feel that we have made a mistake, please privately contact a Cryptic Studios and we will review the situation.

The part in bold is all that matters, and well if they said it has to go, the debate, is moot. It has to go, end of debate.

I have yet to see a rule say that is has to go for avatars. All ive heard is some stranger on the forums talking about it.
Nothing but hearsay. Till i get an email or infraction or i see a rule saying "avatars" cant be gifs or perhaps him posting a copy of his email* wait he cant :D* this is all speculation.

this avatar is TRIBBLE me over though I keep wondering who is posting this TRIBBLE only to realize its me,
