Question about the DS9 holo bridge officers

I like that they are adding holographic bridge officers to the DS9 pack, but what about the main cast members? Are we going to be able to get Sisko, Kira, Odo, Worf, and the many others?

    I'm just curious if we'll be able to get the officers in Infinity Lock Boxes after this lock box passes.

    I would say that depends on Image Rights more than anything. Just because the characters appeared in the game doesn't mean explict permission to use as Holo Boff's. So depends on the Contract.

    By the letter, yes, but they're also assuming full liabilities in the extremely unlikely event that there's litigation over their designs.

    No, no we aren't. Actor likenesses are specifically negotiated. Cryptic cannot freely create actor holograms without contractual authorization (with appropriate with monetary costs). So, if it didn't happen here, then it's not likely to happen in future (either the actor refused or Cryptic didn't ask). There's no spill-over effect, especially to old cameos (their contacts would have to be renegotiated) or actors who aren't appearing in the game because of price or personal reasons (ie. Sisko).

    Calm down buddy. I don't view someone sharing something they think I might enjoy as the personal attack you seemed to. After looking at those costumes I think they are AMAZING and if we never get an official version of Sisko and others those will definitely be a great substitute. Much appreciated to the folks who made them!

    Actually you are wrong. The *ONLY* part of the TOS that mentions actor likeness is the foundry. Actor likeness use is not mentioned ANYWHERE else in the TOS. The TOS does *NOT* say that you cannot create your own character or bridge officers to look like actors. It only says you cannot do so in foundry missions.

    Actually you are wrong. The *ONLY* part of the TOS that mentions actor likeness is the foundry. Actor likeness use is not mentioned ANYWHERE else in the TOS. The TOS does *NOT* say that you cannot create your own character or bridge officers to look like actors. It only says you cannot do so in foundry missions.

    The difference with the TOS is that the Foundry EULA explicitly prohibits the use of actor likenesses (as well as any content you can't grant the license to) with the direct implication that Cryptic can remove any Foundry content that they object to. It's very strict and very straight forward (since it's content they're publishing.)

    The TOS prohibits creating content you don't have licenses to but it's not clear how they could enforce violations in-game (beyond suspending accounts). The major correction would appear to be through license holders litigating against users customizing their characters/boffs, which in context would be tantamount to litigating against fan art (unlike published Foundry missions.)

    If STOcostumes sold access to their work or setup a patreon account, then there'd likely be objectionable issues (very easily monetized damages.)

    Nothing you just posted says anything about actor likeness. The only time the word "likeness" is used in the entire TOS is in the foundry section.

    OK, everybody calm down.

    To the OP, of the characters that you specifically mentioned, the only ones that we might have a chance of getting as Holo-BOFFs would be Kira, Odo, and Worf as their likenesses are already now in-game, this would also include any of the other DS9 actors that are also being introduced with VIL. That being said, we didn't get them. We got some of the actors as Holo-BOFFs with the notable exceptions of Kira, Bashir, Odo, and Garak. Is it possible we might get them at some future date through some other promotion? I suppose, but I wouldn't count on it. Worf has been in-game for quite some time now and we still don't have him as a Holo-BOFF.

    As to the issue of the character likenesses created in the Tailor, first, that's off topic, so all of that discussion needs to go somewhere else. I believe @stocostumes has a thread in The Art of Star Trek Online subforum with these very creations being shown off there. Second, to address the issue itself, I asked about it, they are fan-made creations and as long as they are advertised as such, they are fine. They are not official in any way, and they are not sanctioned by CBS, PWE, or Cryptic, so the legalities of it covered. The ToS for the Foundry regarding restriction of use of such likenesses still applies, though.

    As with all contents of a lock box, be it one planned and announced for the future or one currently in the game that is to be modified, nothing is certain. There has been no announcement or official notice yet that the holographic bridge officers in question will be available in a future iteration of the Infinity Lock Box, so speculation is all that is available at the moment. In all likeliness, said content may be provided in the Infinity Lock Box if they draw enough interest.

    Everything from all old boxes (other than retired T5 ships replaced with T6 variants) is available in the Infinity Box. No reason why these BOffs would be any different.

    Its a minor thing but it would be nice if the holoboffs kept their faction symbol's. I get annoyed when I see the Klingon faction symbol next to Loriss or Rex. It would also be nice if they had Dominion Photonic, and Android boffs.

Players can't, for exactly the same reason that they can't use them in foundry missions. This is explicitly stated in the tos agreement and the EULA. Both of which apply to all aspects of the game

    I'll say it again - no, you do not have the right to create toons in the likeness or approximate likeness of

    I'd say it's actually pretty likely to get hologram DS9 characters, but it would unfortunately not be in the way most people hope. I'd bet we'll be able to get them as a convention reward, rather than as freely obtainable officers. At this point, it may just be part of the standard contract or negotiations, we've gotten La Forge, Leeta, and Nog, and they're already characters in the game, so it would be reasonable to assume that it could happen again. It's just that main cast characters are a bit more popular than Kurland or Sarish, so they'll be kept as a special incentive, just in case. As for lockboxes, there's really no good reason why they wouldn't take everything from the DS9 box once it's retired, so I really doubt it's something to worry about.

    As for custom creations... We've already got moderator confirmation that it's totally within the rules to create likenesses of other properties outside the foundry, and even a link to a thread where that exact thing happens all the time. The case is closed. You don't have ground to stand on Lazarus, break up the fight and try to save a little face.

    [Mod Hat] So we're clear, this comes by way of our friendly neighborhood Community Manager @ambassadorkael#6946; that's as official as it gets. Outside of the Foundry, basing toons or boffs on real people is okay as long as it's clearly a fan creation (i.e. no trying to pass it off as official: that will get a smackdown that will make your head spin). As mentioned, the Foundry operates on a stricter set of rules: mimicking Cryptic-made characters in the Foundry (e.g. making your own James Kurland or Tiaru Jarok) is allowed, mimicking real people or canon characters played by live actors is not.

    For bonus points I also asked Stacey Lantagne (IP law professor at University of Mississippi and part of the Legal Committee at Archive of Our Own) about this at a sci-fi con back in January. Right of publicity belongs to the actors but this doesn't really collide with that. [/Mod Hat]
