It is the actor's likeness not the ships to my understanding.

So if you place an image of Patrick Stewart into the Foundry and call him Picard. Cryptic ends up getting sued by Mr. Stewart's attorney. The same could be said if you place an image of Ryan Hart in the game and call him Ryan Hart.
