enemy signal contacts

When flying up to enemy signal contacts, sometimes they are ship, and sometimes they are a swirling cloud of ships. Is there are reason for these two different icons, and is there a way to tell if a battle has already begun? Oh and sometimes your invited to join the battle and sometimes your just sucked into it.
Is there a way of not getting automatically sucked into a battle your not wanted to fight?

    When the Deep Space Encounters are visible as ships, they roam, and even target, chase, and try to suck you in. Once somebody gets sucked in, it freezes and turns into a swirly for an unknown (to me) amount of time. Then it turns into a ship and starts roaming again.

    The only way to prevent getting sucked in is to fly around and avoid them. There's no way to tell from outside if the battle has begun or if it is on cooldown. You can, however, open MAP and try to change instance if the timer is too long. If you don't feel like fighting, you have the option to warp to sector when you first get in.

    Fleet Actions are different and will ask you if you want to join in.
