So, we have 2 options: Multiple Instances, or multiple servers. Hows about you are forced into the most populated instance until it is full, then you are moved to the next instance. The difficulty is based on a scale of how full that instance is. I think that would make everyone happy. Also, increase that number from 5 to at least 20, or hell, 50. This is an MMO. I want a gigantic war every time I play, not a pansy fest.
Is that so hard? No. I know it can be done in a day. Do it.
Also, make the re-spawn point a safe area. I am tired of re-spawning in a DSE only to be surrounded by 10 ships and blown teh **** up, again, and again until I can leave, or hit full impulse and get away.
I think all they need to do is ensure there's enough instances of the non-mission zones for the number of players and bind people to them. It would take away the random feeling and make them more transparent. They can still have an option to switch if a player desired.

I think he is referring to the fact that all 80 of the Lt Commander deep space encounter missions have 1-2 people in them instead of the capped 5.

I agree overall but I emphasize my support of this point. Whether you believe in a DP or not, if they are going to do ANY sort of DP they need to fix THIS first.
