So I'm waiting in front of the Breen race official and I'm actually waving my hand and some other person runs up and they start waving after me and they beam to the track and start their race and I fail how does this work?

Lag most likely. Its only happened to me once this year so far.

If a player activates the breen slightly after you do, they will be transported to the start while you will be rooted to the spot in which you're standing. I've been able to reproduce this dozens of times.
When you see "TRIBBLE" in my posts, it's because I manually typed "TRIBBLE" and censored myself.
The good part is, if someone does it.. they are teleported to the track.
If that happens, you just run back to the Breen and re-aquire the mission. If the Griefer wants to do it again, he has to leave the track to fail the mission and then re-aquire it so he can't just camp there and wait for you. At most he will just get you once.
I also saw the same Toon jump onto the track at the very end and race to the end with me after. Again out of nowhere.
I hope he didn't get anything out of that.
Nope, the server logic can mess up the race start when two people wave close together but there is no double reward from griefing people. That jumping onto the track might actually have been starting a second attempt after failing to win the first race he stole from you.
I accidentally did this to someone that I figured was afk last week. I've had it done to me a couple of times since then. I figured the first one was my comeuppance for the earlier time that I did it. The second time, however, I didn't get rooted, and was able to run out to the track and do my race, which was nice.
One thing that they seem to have fixed about it this year is that a poacher actually does get an NPC to race against, and may be rooted on the track until the countdown ends, just like a normal race.
Oh, and someone sent me a tell to Wait one time this year, too. It didn't happen until I'd already signaled. If you have time to do a PM, you have time to hit F and start the race. "First come, first served" may be a rule that we live by in the real world, but "TRIBBLE or get off the pot" is as well. Don't be rude by cutting, but also try not to waste everyone else's time.
This is an MMO, not a Star Trek episode simulator. That would make for a terrible game.
Long standing bug, one of many they've never fixed and a good indication (like Q not sitting correctly in his chair) that the company and its employees just don't care.

This frustrates me a lot and has for many years. You go first, but the 2nd guy gets in. Then you get failed and have to run back and reacquire the mission.
I don't think it's lag, cause I've done it a couple times to people as a test to see if it was.
Haven't had that happen this year, probably thanks to fewer racers due to the account unlock introduced last time. During the last years I mad a habit of waiting a bit if somebody was already standing close, first to see whether they were actually queueing before me, in which case I wouldn't want to be the a-hole. But also to avoid this, many of these campers are actually quite jittery and will push quite quickly. Wait them out, problem solved. And even if you fail, it's not as annoying as leaving track south of the lake. Still can make one grumpy, because people who are abusing this may lead a poor life, but that doesn't give them the right to annoy me in my book.

Haven't had to queue so far this year, but last year I trolled the trolls on a couple of occasions, the first player gets rooted by the troll, but if someone else is fast enough they can root the troll and get put on the track instead.

No, originally it worked properly. Back then it required you to run 25 times per toon instead of per account so there were always lines at the race start. And by "lines" I mean a huge mess of people standing around the starting guy all mashing 'F' as fast as they can to get in before the others. If the bug had existed back then the whole lot except one would've failed it every time.
I figure since there are never lines like that anymore, the devs don't see the issue as being that important.
This year is the first one I've never run into a soul on line or for the most part within 20 metres of the Breen.

Unlocking with just 40 for every other character after the first didn't come into play until the 2014 event, then account unlock by just one character in 2015.
I was not playing the game during the 2012 event, so I can't say if this line-cutting was happening then.
