You are, but when the Anniversary is over, it'll be part of the mission chain and only available to run at level 60.
If you plan on upgrading them past VR XII's (or do they default to XI?), keep the low-mark ones you have. Because of the way the upgrade system works -- or doesn't, depending on how you look at it -- you will have a far easier time getting to UR or Epic (maybe) by upgrading the lower marks. It will cost more to upgrade quality on the Mk XII's.
I tried to upgrade the MK IV but it required upgrade mats. Thats not free.
Well, there is the Omega Tech Upgrades that you can craft which can be used to upgrade just about any gear (not kits though). They provide double the tech points and rarity increase chances compared to the typical "superior" upgrades that you craft using mats from queued missions or purchased from the Exchange.
The catch is you must play the Omega Particle Mini-Game that is part of the 2015 Anniversary Event (which has been extended to March 2nd) to gather the required mats be begin the process that will eventually allow you to craft Omega Tech Upgrades. Basically it works as follows:
When the 2015 Anniversary Event ends all the Omega Nodes scattered throughout the game will disappear which means the Exchange will be the only source for someone to get more Omega crafting mats. The Special Event Omega Tech Upgrade crafting projects (in the Science the science school) will remain for a period of time. However, Cryptic has not announced when they will disappear yet.
If you do not care about crafting, but you are interested in making EC, then selling "Omega mats" is an option. However, you need to be good at the mini game to get Omega Traces and Omega Slivers as quickly as possible.
Based on yesterday's Exchange prices an Omega Trace (Red, Blue, Yellow) sells for about 25k EC while an Omega Sliver sells for about 80k EC. As the Anniversary Event draws to an end prices on the Exchange should increase because soon there will not be any Omega Nodes to mine for more traces and slivers.

This is going back a few days, but the price of slivers varied considerably. It was ~95,000 for me mid-morning (~10am) GMT, and slowly dropped to ~80,000 by late (~11pm)GMT.
