I am asking as I have been trying to tame a backstabbing scorpion and have been successful after an hour with the monster's life kept at less than 10% of its max.

Answer 1 :You can tame only pets equal or lower to your level .
Answer 2 :Yes there are monsters than cannot be tamed .
Answer 3:Yes ,a few of them can .
The monsters that can be tamed have a "pet" small head at left down corner of the monster info when you target it. There are 3 colors.Green (that means you can easy tame it),yellow (that means you maybe not tame it with first try) and red ( that means you cant tame it at your current level). Also taming pet need to level your taming skill for more success attempts.Higher level,better chances to tame it.

I'm not sure how exactly these "chances" work in game, i was always able to tame pet with 10-20% hp even with lvl 1 tame skill. At the same time i failed a lot at 40% hp with maximum pet tame lvl. For me it looks like it adds nothing but distance of casting.
Better use another pet to decrease your target's hp little by little or hit it with veno if your attack is not too high to kill it by accident. Another pet is better for that purpose, since veno can crit while pet can't, and some mobs interrupt channeling, so it will be better if your target attaks your pet, not you. When its HP at about 10-20%, make your pet stop attacking and cast tame skill. Even though it is said "chance is higher, chance is lower" you will surely tame your mob, if you are careful with attack and do everything right.

The list of monsters that can be tames is so much shorter.
