its just too hard not to skim close. there are tons of batmans, supermans, hulks, ironmans, wolverines ect... out there.
Just because others are doing it doesnt mean you should.:biggrin: Personally, I'd maybe incorporate a second color or something to really make it stand out as more than an homage. All in all, it's well done.

Yeah the ToS pretty much says no copyrighted names or similarities of copyrighted characters. The trick around this is make like a iron superman call him Man of Iron (if it's not copyrighted) so kinda robotic look of Superman.

There is nothing wrong with making homages based on your favorite characters and as long as you don't violate ToS you are fine. If you play the game CO does it themselves all the time , so why can't we?

And, i agree with ealford, i think it's ok make a version of your favorite characters, it's a tribute, i dont know. There is so many examples of this kind of thing in real world, like cosplays, characters in children's birthdays, ultimately, a lot of peoples using costumes of your favorites Super Heroes out there, just for fun.

Anyway, i think is not real possible make a exactly copy of these heroes in the game, you can make much like, but, never a full copy.
As for copying, go by the Rule of Three: Appearance, Name, Bio. If two of the three are too obviously similar to a trademarked character elsewhere, report them. It helps avoid legal issues with major publishers - especially important since Marvel's acquisition by Disney a few years ago, as now their old legal department is backed by the Mouse (which can be a bit rabid...).
Homages and parodies are permissible, so long as it's obviously not a copy attempt (say, a Batman homage named Chiroptera, whose bio states that he was inspired to create his costume by a comic book he loved in his youth). My own menagerie includes two examples - Spider-Bat, whose costume is a Spider-Man/Batman mashup, and whose real name is Peter Wayne (his bio states that he was hunting rare spiders in the Amazon when he was bitten by a rabid radioactive bat, and became a little confused), an obvious homage - a double homage, in fact; and Captain Americlown, whose costume is a clown version of Cap A's, and whose bio reads, "We never should have subcontracted the Super-Soldier program to that guy from Ringling Bros." He's clearly a parody.
