  Unless its a Gift it depends, usually a lot of artists have terms of services that require you to have permission to use someone's else character(s) in a commission in order to avoid trouble/drama for drawing a 3rd person's character​​

  Echoing what Avianos said, most artists require contact with the other person as well so that portrayal is accurate as possible.
  
  Example, when I got a commission of my character and Cyrone's, we both were in contact with the artist.
