Nemesis gear is great for leveling only. Once your character gets to level 40, you should transfer that gear over to a leveling alt. Hence "heirloom" gear.
Your new 40 should invest in some new gear with mod slots. In ascending order, the best primary gear upgrades are Mercenary, Qliphothic, Heroic, and Legion.
After this, there are even better primary gear sets that require Silver and Gold Champion Recognition like the Justice or Virtuous gear sets. These require serious investment and can be purchased in the Recognition Store.
The best secondary gear, in ascending order, is Armadillo, Vigilante, Determination, Cosmic, and Onslaught Gear. The last 3 accept various mods up to rank 5. Armadillo gear is fine for leveling too, but weak secondary gear for a 40.
Some of the gold sets offer different options, but nemesis gear is better for leveling a character than a character that is already leveled.
That is to say that there are better options out there. No one can force you to use any of it, but there are better options.
Primary-wise, Mercenary or Qliphothic (cosmic?) gear is fine for a level 40 if you want to go that route. Both are blue gear so you can look for blue primaries in the AH with any of those names attached. Legion's gear is better (purple), and then there is some Gold Champions Recognition gear beyond that.
For secondary gear, any purple level 40 is fine as long as it provides matching/useful stats for your character. Just running around as a level 40 should net you some of this and you can find some in the AH for fairly cheap. Vigilante's gear in the questionite store is better, as is the stuff you can get from running Teleios Ascendant, and then there are GCR offerings here as well.
Any particular gold set is going to vary. You'll just have to look at each of those individually. Some sets might be better for some characters than others.
I think that covers everything. Someone more into numbers might come along and further sort things, but I am working from memory.
purple secondaries are CHEAP in the SCR store. 15 SCR each and you get to choose the stats....
Though gear pieces with Con cost more, naturally.
